Looting in Los Angeles (How Much Longer Will This Last?)

This is the new normal in Los Angeles.

Rampant looting with no regard for the rule of law. Is this what Gascon supporters really wanted?

I want every Gascon voter to explain why they think that this is acceptable.

I want every progressive who defends the rampant raping and pillaging of small businesses to explain why they find this acceptable or even tolerable.

What reforms are really in play to make any of this acceptable?

Vote for bad politicians, and get bad results.

Will the voters learn? Or has the spirit of lawlessness become so strong, that there is no hope?

Perhaps there are too many people who vote for a living, and for that reason they have nothing but poverty as their lot.

If you are poor, you have nothing to lose, why not keeping vote Democrat? Why not keep voting for the corrupt machine?

It's a sad thought, but I guess there is no escaping the truth of the matter: urban Democratic areas are doomed. There is no way out of the cycle of poverty and dependence, and there is no escape from the delusions of secular dystopia.

Reminder: Jen "Karen" Graham Promotes Violent Hate Group

Jen "Karen" Graham of Torrance
promotes violent hate group
Southern Poverty Law Center

In a previous post, I shared with you the defamatory hate written by "Torrance Community Group" Admin Jen "Karen" Graham.

Here's the post that she had shared about me. She has a special level of Schaper Derangement Syndrome thate I cannot begin to understand.

It's really sad. I don't understand why some people in the city of Torrance insist on allowing me to live in their heads rent free. Don't they have lives of their own? There is something of a mental illness afflicting these poor souls, and I can only hope that they get some help.

At any rate ...

In one of her first comments, she defames me as a "national agitator for a national hate group."

I worked for an international (not national) pro-family organization called MassResistance. You can learn more about them here.

Now, why does she defame MassResistance as a hate group? She relies on the slander of a real hate group: The Southern Poverty Law Center:

The Southern Poverty Law Center is not just any ordinary hate group, however. They are a violent hate group which instigates terrorist threats and attacks against anyone whom they disagree with.

So, because Jen Graham slanders MassResistance by referencing the SPLC, one must accept that Graham promotes a violent hate group herself.

The Family Research Council can attest to this. They were attacked by a deranged gunman who wanted to kill as many people as possible in the building. Why? Because the FRC was unjustly placed on the SPLC's "Hate Map."

The First Works Baptist Church in (majority Hispanic and Asian) El Monte can testify to this hate, as well. They were firebombed by a deranged domestic terrorst because ... (wait for it) the SPLC defames them as a hate group. A church being labeled a hate group and getting firebombed ... this reminds me of the same line of domestic terror waged by other Democrats in the South who wore white hoods and terrorized minority communities, aka the KKK.

But back to the Hate Group from Alabama.

The Southern Poverty Law Center vilifies men, women, immigrants, Jews, Christians, and Muslims who do not agree with their radical, aggressive, progressive agenda. They even create a so-called "Hate Map" to set up these innocent groups to be targeted!

Let's state the facts plainly: Jen Graham of Torrance promotes and supports a violent hate group.

And if you need any further evidence of this long litany of hate regarding the Southern Poverty Law Center, just click here.

No Such Thing as Palestine: What PLO Activism in the USA is Really All About

The Goal of Palestinianism

What the supposed quest for Palestinian statehood and social justice is really about.

By Richard L. Cravatts

A recent survey conducted by Alums for Campus Fairness, “A Growing Threat: Antisemitism on College Campuses,” asked some 500 Jewish-affiliated college students and recent alumni what their perceptions were regarding campus anti-Semitism. The findings of the survey were troubling, given that: “Nearly 100% of respondents said antisemitism is/was a problem on their campus,” “95% of respondents identified antisemitism as a problem on U.S. college campuses, with three out of four describing it as a ‘very serious problem,’” almost “half of current students say antisemitism is getting worse on their campus,” and “69% of students and grads say they have avoided certain places, events, or situations at school because they are Jewish.”

Anyone familiar with current state of affairs on university campuses knows that the root of much of this animus towards Jewish students is the ongoing university campaign against Israel and Zionism, and that Jewish students, whether they even support the Jewish state or not, regularly find themselves the target of derision, bigotry, and condemnation simply because they are Jewish.

In fact, research has demonstrated quite clearly that agitation against Israel—including the toxic Boycott, Divestment, and Sanctions (BDS) campaign—by such corrosive student activists as Students for Justice in Palestine (SJP) increase both the frequency and intensity of anti-Semitic speech and expression. A 2019 report by The AMCHA Initiative, a campus anti-Semitism watchdog organization, for example, revealed that “BDS’s mandate to boycott or suppress programs, collaborations, events, or expression that promote ‘the normalization of Israel in the global academy,’ as well as the academic BDS-compliant ‘common sense’ mandate to criticize, protest and boycott individuals who are deemed complicit with or supportive of Israel’s alleged crimes, appear to greatly encourage antisemitic behavior.”

An earlier AMCHA report had found similar connections between anti-Israel activism and the presence of anti-Semitism on those campuses with SJP chapters. That report concluded, shockingly, that the “presence of one or more anti-Zionist student groups is very strongly correlated with the overall number of antisemitic incidents. 99% of the schools with one or more active anti-Zionist student group had one or more incidents of antisemitic activity, whereas only 16% of schools with no active anti-Zionist student group had incidents of antisemitic activity.” Campuses with SJP or other anti-Zionist student groups, the report found, were “very strongly associated with the occurrence of antisemitic expression. 91% of the schools with one or more active anti-Zionist group showed evidence of antisemitic expression, whereas only 16% of schools with no active anti-Zionist student group showed evidence of antisemitic expression.”

SJP and other student groups, along with their faculty sponsors, are the foot soldiers in the worldwide campaign of Palestinianism, but the ideology which animates the Palestinian cause is evident not only in the ivy walls of academia, but also in the UN, NGOs, the State Department, the Arab street, and in parliaments and congresses where the chattering classes purport to be committed to Arab self-determination and seem to have no issue with sacrificing, if necessary, the Middle East’s sole democracy as part of that effort.

Central to this propaganda campaign to enshrine Palestinianism—in which the suffering of the Palestinian has finally trumped the historic suffering and dispossession of the Jews—is the wholesale, deliberate appropriation of the language and symbols of the Jews by the foes who wish to eradicate, not only the Jewish past, but the very existence of the Jewish state. Thus, the actual genocide of European Jewry during the Holocaust is either minimized or denied by the Arab world at the same time that Israel is denounced for committing a new “holocaust” against the Palestinians through ethnic cleansing, military barbarism, and war crimes.

Palestinians regularly refer to themselves as being dispersed in a Diaspora, what they call their own “Nakba,” a catastrophe, just as Jews had traditionally spoken of their own scattering from their homeland after the destruction of the Second Temple. While Arab aggression and homicidal impulses against Jews have been unrelenting—before and since the creation of Israel—Palestinianism has been successful in casting the Arab Palestinians as the perennial victim of Jewish supremacism, even though the irredentist aims of the Islamists to establish a Muslim-only state in historic Palestine is the very form of self-determination that is repeatedly decried on the part of Israel for being racist, inhumane, internationally criminal, and morally unacceptable.

The West’s wide embrace of Palestinianism has been led, for the most part, by the intellectual elites, whose own biases against Israel and the United States serve to animate, and widely promote, the campaign to vilify, defame, and delegitimize Israel. While the ideological antics of anti-Israel student groups are the most visible aspects of the hate-Israel agenda, this acting out and shrill rhetoric from students would be inconsequential were it not for the full intellectual and moral support this movement enjoys from faculty members―those with the prestige and academic muscle to lend credibility and influence to the war of ideas against the Jewish state.

The liberal slant of university faculties has made it inevitable that many college professors question the integrity of Zionism, if not forthrightly denounce the very existence of Israel as a moral stain on the world that oppresses Arabs and tars the United States as an accomplice in this perceived unjustified colonial, militaristic oppression. The self-righteous professors who perpetually denounce Israel, though, may or may not have a great moral commitment to the Palestinians at all.

In fact, that is often incidental to their primary objective: not to actually assist the Palestinian self-determination with constructive, tactical advice and support—which has always been sorely, and visibly, lacking—but to weaken support for Israel with the ultimate intention, shared by Israel’s jihadist foes, of eventually eliminating it altogether. The phony rectitude which they use to insulate themselves from critique comforts those who would otherwise see the fundamental moral cruelty of their assaults of Israel. And they are also craven in their self-righteousness for taking such a strident stance against Israel, a point of view and a philosophical approach that requires no courage in the Jew-hating West.

Of course, virtue-signaling one’s commitment to the oppressed is rampant among the campus Leftists, many of whom feel that, because they seek social justice for the Palestinians and are attempting to strike down what they define as the new Israeli version of apartheid, anything they say or do to delegitimize Israel is acceptable, even necessary. Thus, they hector Israel to mend its political ways not only to end Palestinian suffering, but also, they allege, for the good of both Israelis and Diaspora Jews.

These fatuous professors (and their complicit students), who never have had to face any physical threat more serious than being bumped while waiting in line for a latte at Starbucks, are very willing to scold Israel when it defends itself from unceasing rocket attacks from Gaza meant to murder Israeli civilians. These same professors, many of the vilest critics of whom are from departments of humanities, literature, anthropology, history, and sociology, are, without any expertise in military affairs, eager to advise Israeli officials on the rules of war and denounce the lack of “proportionality” in Israel’s attempts to defend its population from jihadist murderers. And so eager are they to publicly assert their righteousness as defenders of the Palestinian cause, they embrace and “eroticize” terroristic violence and willingly align themselves with Israel’s deadly foes who seek its annihilation, catering, as essayist David Solway lyrically put it, “to the ammoniac hatred of the current brood of crypto-antisemites [sic] posing as anti-Zionists.”

This cultural condescension, the disingenuous lie from the Left that all cultures are equal, but some are more or less equal, to paraphrase Orwell, leads liberals into the moral trap where they denounce Israel’s military self-defense as being barbaric, criminal, and Nazi-like (because Israel is a powerful, democratic nation) and regularly excuse or apologize for genocidal Arab terrorism as an acceptable and inevitable result of a weak people suffering under Western oppression. Violence on the part of the oppressed is accepted by liberals because it is deemed to be the fault of the strong nations whose subjugation of those defenseless people is the very cause of their violent resistance.

In fact, when Israel-loathing Leftist professors, such as Columbia University’s toxic Joseph Massad, apologize for Palestinian terror, he justifies it by characterizing the very existence of Israel as being morally defective, based, in his view, on its inherent racist and imperialist nature. For him, nations that are racist and imperialistic cannot even justify their own self-defense, while the victims of such regimes are free to “resist,” based on the Left’s notion of universal human rights―but especially for the weak. “What the Palestinians ultimately insist on is that Israel must be taught that it does not have the right to defend its racial supremacy,” Massad has written, “and that the Palestinians have the right to defend their universal humanity against Israel's racist oppression.”

As part of academia’s fervent desire to make campuses socially ideal settings where racial and cultural strife ceases to exist, Palestinianism gains traction as part of the campaign to realize “social justice” for marginalized victim groups—the long-aggrieved Arab Palestinians among them, now the Third World’s favorite victim.

For the Left, according to David Horowitz, a former radical leftist turned conservative, social justice is “the concept of a world divided into oppressors and oppressed.”  Those seeking social justice, therefore, do so with the intention of leveling the economic, cultural, and political playing fields; they seek to reconstruct society in a way that disadvantages the powerful and the elites, and overthrows them if necessary—in order that the dispossessed and weak can acquire equal standing. In other words, the Left yearns for a utopian society which does not yet exist and is willing to reconstruct and overturn the existing status quo—often at a terrible human cost—in the pursuit of seeking so-called “justice” for those who, in their view, have been passed over or abused by history. According to Horowitz, this “radicalism is a cause whose utopian agendas result in an ethic where the ends outweigh and ultimately justify the means,” a view which has meant that Western leftists have come to share sympathy for the tactics and ideology of jihadists who seek to overturn Western ideals in their pursuit of an Islamic caliphate, what Horowitz calls an “unholy alliance” of the Left and Islamists in their pursuit of social justice.

In this dangerous alliance, Israel is continually slandered as a racist state, an aggressive, militaristic regime that inflicts disproportionate suffering on the hapless Palestinians, lubricating the argument that this inequality is inherently and inexorably wrong, that it must be corrected and made just. Thus, when such radical student groups as Students for Justice in Palestine have as their core mission, as their name implies, bringing their own vision of justice to the Middle East, it is justice only for the oppressed, the Palestinians, and not for the oppressor, Israel, whose position of power was made possible only because of a “hierarchy of class and race [which] exists globally.”

For the Left, social justice is solely for the disenfranchised, the ‘victims’ of unjust Western societies, those whose suffering is ostensibly caused by and is the fault of imperialistic, capitalistic, militant, hegemonic nations—America and Israel foremost among them. And on campuses, where liberal professors have nearly made sacred the politics of race and class and have identified specific sets of favored victim groups for whom justice will be sought, the cult of “victimhood” has even led to compulsory instruction on the mechanics of achieving social justice for the weak in society.

This view of the Jew, or of Israel, the Jewish state, as a political destabilizer, is, of course, also central to the ideology of Palestinianism and the notion that the victims of Jewish power are the dispossessed and weak for whom liberal academics purportedly seek justice. Any tactics, including terror and violence, are considered appropriate and excusable in the victims’ cause of throwing off the yoke of oppression, so the Palestinian, clearly made to suffer daily humiliation and endlessly deprived of a homeland and the right to self-determination, has become the perfect example of the contemporary victim archetype, the Third-World “other,” an ever-present, homeless, dispossessed tragic refuge whose plight could be traced directly to supposed colonialism on the part of the “settler” state of Israel.

This rationalization, that violence is an acceptable, if not welcomed, component of Palestinianism—that is, that the inherent “violence” of imperialism, colonialism, or capitalism will be met by the same violence as the oppressed attempt to throw off their oppressors—is exactly the style of self-defeating rationality that in this age has proven to be an intractable part of the war on terror. America-hating and Israel-hating academics have not infrequently wished for harm to come to these countries at the hands of the victim groups to whom they readily give their sympathies. They frequently, and mistakenly, ascribe to poverty and helplessness the inclination to lead to terrorism on the part of otherwise weak and oppressed individuals. And, like leftist apologists for revolutionary violence in earlier examples of resistance, they see an opportunity for the tables to be turned on the oppressors and an equal distribution of suffering to be brought about in the resulting power shift.

The nearly total rejection by the Left of any recognition of goodness on the part of Western countries, cultivating and promoting Palestinianism, is, according to commentator Melanie Phillips, symptomatic of academics' belief in their own moral superiority, a feature which, at least in their own minds, gives them a more genuine and principled worldview.

“In the grip of a group-think that causes them to genuflect to victim-culture and the deconstruction of western morality and the concept of truth,” Phillips wrote, “a dismaying number of our supposedly finest minds have been transformed from people who spread enlightenment to those who cast darkness before them.”

Ben Lourey, and the Mindless Bigotry of Black Lives Matter, El Segundo

Black Lives Matter is a hate group. If you don't believe me, check their website.

You can also hear their hateful chants against the police, law enforcement in general, white people, Jews, Israel, and black people who think for themselves.

They are already doing their best to fight back against their growing exposure in the general public. As more people realize what Black Lives Matter is really all about (and it's not about black lives), the more that these groups are genuinely and roundly repudiated.

The group that has formed in El Segundo is trying to distance themselves by calling themselves "El Segundo for Black Lives".

It makes no difference. They are just another iteration of "Black Lives Matter", nothing more.

No one should fall for this fraud.

Some racist, uppity white liberal outsider named Amanda Touchton moved into the city of El Segundo looking to cause trouble in the wonderful "Mayberry By the Sea" community.

And now, Black Lives Matter El Segundo is going around the city, pressuring the city council and the school board to enact a set of unreasonable, immoral policy demands which have nothing to do with good governance or well-being in the city.

In fact, this group wants to give off this narrative that El Segundo is some essentially racist city that needs to repent of its long-standing sins. Residents of diverse backgrounds who have lived in El Segundo for decades can attest that the city is indeed quite welcoming.

On the other hand, Black Lives Matter El Segundo activists are anything but tolerante. They have twisted Scripture, they have cast shameful aspersions on a welcoming city. They disparage the police department and its other civic agents.

And check out an average member of the Black Lives Matter El Segundo group: Ben Lourey

This video contains my first interaction with him in its entirety.

He called me a kook, a racist, and other abominable names.

He got close to me, then told me that I had to engage in social distancing from him. He got in my face, but wanted to make it my fault that I was not six feet away from him. Give me a break.

When I called him out and the entire Black Lives Matter movement for not caring about black lives at all, he became enraged and indignant, and began shouting other hateful messages at me. At one point, he made it clear that he did not care about the black lives that get gunned down in Chicago. Wow! Such hypocrisy, and such bitter vitriol.

This is Black Lives Matter, folks: mindless bigotry hell-bent on virtue-signaling how "woke" they are compared to everyone else.

Watch the video for yourselves, and you will see that this movement is not about love, tolerance, and inclusion. This is just a part of a larger, militant, abusive agenda, and now it's targeting El Segundo to commit greater harm against others. This cannot be tolerated!

California MassResistance is committed to fighting back against this scourge and abuse of power in El Segundo, throughout Los Angeles County, and throughout California and the United States as a whole.

Dear Batsh*t Crazy Left-wingers: Did You Think You Were Going to Get Away With It?

During public comment at this Huntington Park City Council meeting (the city which had appointed two illegal aliens to city commissions), I mocked the corrupt police chief who had had me arrested for no reason in a previous meeting, then I shamed the city council. Someone in the audience shouted at me: “Why don’t you go to Malibu with that bullsh*t?”

The mayor called me out of order, and it was not clear she had said anything to the man who had shouted at me. Everyone else in the audience erupted in outrage. I yelled at the city councilmembers, who fled into closed session. With shock in his eyes, I confronted the left-winger who had yelled at me: “Did you think you were going to get away with it?”

It was vindicating and gratifying. When people who have endured repeated abuses finally see the tables turn on evildoers, it is wonderful. Unfortunately, the Left still believes that they can get away with “it”, i.e. abusive, disorderly misconduct against conservatives, peace-loving taxpayers, and American of all backgrounds after all this time. Why? Following the example of their evil godfather Saul Alinksy, these radicals exploited everyday civility. Most people give in rather than fight back because people simply want to live and let live.

However, “Leave me alone” means nothing to committed ideologues. This passivity allowed the Obama Administration to redefine justice with identity politics and discarded reality. Bureaucrats crushed the rights of citizens without reprisal. The Deep State was deeply invested in intimidating conservatives and shutting down free speech. Thugs burned up entire cities in the name of social protest. LGBT activists have not only demanded their “fair share” of protections but focused on ripping away other people’s rights.

The abuse came not just from activists and the government, but from the corrupt press, in part because they downplayed or ignored the abuses of the Left. They also lied a lot. Here’s one list of devastatingly false news reports. Thankfully, in the last five years we have seen the left-wing pundits, prognosticators, and preachers finally getting their due. One epic media smear collapsed when audio leaked out the full commentary from Clive Bundy of Nevada, who had stood up to the overreaching Bureau of Land Management. Martin Bashir of MSNBC was forced out when he suggested that people should be allowed to defecate in Former Vice Presidential nominee Sarah Palin’s mouth. Left-wing mouthpiece Piers Morgan lost his slime-time talk show, too.

While bad journalism was getting busted, Trump is taking the war against Fake News from rare artform to common practice. He routinely slams their epic failures, distortions, and outright falsehoods. He draws on their influence, then uses their disparate market share to diminish them. What European conservatives have been doing for years, Trump has initiated, hosting the first “Fake News Awards” ceremony. Now more “reporters” are getting shown the door. Brian Ross is taking a hike for his fake news about Michael Flynn. The reporter who falsely claimed that the Capital Gazette shooter wore a MAGA hat? He’s gone! When a Los Angeles Times freelancer threatened indie journalist Mike Cernovich on Twitter, the Times swiftly fired the guy.

Paybacks feels good. I had never hoped to see a series of swift, massive comeuppances so soon. I What press agents had gotten away with in the past, they are no longer getting away with today, and the consequences go beyond their unprofessional, fraudulent reporting. Matt Lauer and Charlie Rose got fired for being too “handsy” with female staffers.

Sexual misconduct is prevalent among other institutions on Left, despite all their talk in favor of feminism and against sexism. Candidate Trump led the fight against the Left’s sex-crazed double standard with a press conference featuring the women whom Bill and Hillary Clinton had notoriously abused. Then Big Hollywood producer Harvey Weinstein took a much bigger tumble for abusing his power and abusing multiple women. Today, the whole left-wing entertainment juggernaut is crashing, having flaunted their disdain for Biblical morality for decades while they got away with it. The #MeToo movement that sprang from Hollywood entangled other wealthy and well-connected liberals: actors, writers, and academics—but particularly elected officials.

Everyday social justice warrior mobsters are no longer getting away with their frequent quotidian infractions, violations, and crimes against conservative humanity. One Antifa thug got arrested after harassing pro-Trump patriots at Arizona State University. Another Antifa thug got punched royally in the face after attacking a Trump supporter in Portland. The barroom ballet clip went viral, shaming the violent left, and the Trumpster walked away a free man.

The black punks who bullied a disabled white kid are finally getting justice. Social media ensured that Brown Supremacist Kino Jimenez didn’t get away with stealing a teenager’s hat, and the same technology helped put this hateful college student under indictment for the same crime.
Conservatives are fighting back against private establishments, too. The Red Hen restaurant unfairly turned away Sarah Huckabee Sanders and her family. Now they cannot except walk-in customers because of mounting protests outsider their restaurant. These conservative counter-punches were unimaginable ten years ago.

Martin Luther King Jr. declared “The arc of the moral universe is long, but it bends toward justice.” It’s not the arc of history, since an era is not defined solely by inevitable forces, but choices and consequences. As soon as social media and other tech advances leveled the playing field for informing the public and shaping public opinion, the average citizen could easily report the truth and expose the lies. The big institutions (Media, Hollywood, Academia, Government) no longer have the power to cover up the wrongdoings of the Left while excessively covering the mere foibles of the Right. It is no surprise that the Left is freaking out, raging like cornered animals or spoiled children denying their crimes. They are finally facing their due punishment, that they are no longer getting away with decades of abuse, misconduct, and just plain bad manners.

Antifa of Phoenix "Arrives" (SAD!)

Some members of Antifa did show up to cause trouble at the Patriot Movement AZ rally.

They placed flyers around the park and tried to get the permit for the park revoked.

What a joke:

When they did show up, they were hardly imposing, and not every impressive.

A grand total of ... ten left-wing protesters showed up.

That was it.

They shouted their coarse chants. They cursed at the speakers. During the moment of silence for all Americans killed by illegal aliens, they shouted and yelled. They ended up making themselves look very bad.

Of course, I had some fun making fun of them:

Eventually, they disappeared!

Pro-Family Group Sues San Diego Unified--CAIR Collusion Under Review

Thank God that there are more Californians fighting against the corrupting, anti-Christian, anti-Judeo Christian ethic on which this country was founded.

Islam is a cult, and a dangerous cult at that.

It's wrong for left-wing ideologues to push their agenda onto our students, and to prevent parents from standing up to this destructive agenda.

I am glad for the parents and the attorneys who are fighting back against CAIR and the arrogant San Diego School Board!

Citizens for Quality Education-San Diego

"The philosophy of the school room in one generation will be the philosophy of government in the next." Abraham Lincoln
In the matter of FCDF v. San Diego Unified School District, SDUSD has been expedited by the Court to produce "ALL DOCUMENTS in the POSSESSION, CUSTODY OR CONTROL OF DEFENDANTS CONCERNING CAIR and its employees, agents, and representatives sent or from Defendants since July 25, 2017, which concern the “ANTI-ISLAMOPHOBIA INITIATIVE” and/or the “POLICY”, and including the "ISLAMOPHOBIA TOOLKIT".

As you will recall, the July rescision of the policy by the SDUSD Board of Trustees was a sham and evidence shows the Superintendent continued her association with CAIR. The Court, in a 14-page opinion, found the plaintiffs "established a reasonable need for their expedited discovery" in their Preliminary Injunction.

These records are to be submitted by April 9, 2018, which is the deadline for the district to file an opposition to the motion for a preliminary injunction. A hearing date on the motion (no oral argument) is scheduled for April 23, 2018.

FEDERAL JUDGE: SAN DIEGO UNIFIED MUST PRODUCE RECORDS OF ALLEGED COLLUSION WITH ISLAMIC ORGANIZATION
Families Have “Reasonable Need” for Expedited Records in Light of Request to Shut Down School District’s Supposedly Rescinded “Anti-Islamophobia Initiative”

SAN DIEGO, Calif. – Yesterday, a federal judge ruled that the San Diego Unified School District (SDUSD) must hand over critical evidence to five families as part of their legal challenge to the district’s “Anti-Islamophobia Initiative.” The program, which was enacted last April, singles out Muslim students for special protections and empowers a controversial Islamic advocacy organization, the Council on American-Islamic Relations (CAIR), to vet and revise school curriculum. The Freedom of Conscience Defense Fund (FCDF) is representing the five families in a federal civil rights lawsuit filed last May. Two local organizations, San Diego Asian Americans for Equality Foundation and Citizens for Quality Education San Diego, are also plaintiffs in the suit.

On February 20, the plaintiffs filed a motion for a preliminary injunction with over 200 pages of supporting evidence, asking the Court to stop SDUSD’s superintendent and school board from further implementing the initiative. The school board claimed to have rescinded the program at a public board meeting in July 2017, but extensive evidence uncovered over the past several months shows that the alleged cancellation of the policy was a “sham.” To prepare for the tentative hearing on the preliminary injunction, the plaintiffs now seek communications and other records that took place after the July 2017 board meeting.

Federal procedural court rules typically prohibit early “discovery” until the parties’ attorneys meet to set up a corresponding timeline. However, a court can grant a request for expedited discovery if there is a showing of “good cause.” In this case, the Court found that access to additional SDUSD records is “in the interest of the administration justice” to “more fully develop the factual record on the Plaintiffs’ preliminary injunction motion.”

According to the Court’s 14-page opinion:

Whether or not Defendants’ rescission was a “sham,” facts pertaining to the District’s conduct after the public rescission of the Policy may be relevant to the question of whether Plaintiffs face ongoing irreparable harm from a policy that allegedly violates the First Amendment of the Federal Constitution. Plaintiffs’ assertion of irreparable harm in their preliminary injunction motion stems from the existence and implementation of an allegedly unconstitutional policy.

Charles LiMandri, FCDF’s president and chief counsel, said:
The Court’s ruling affirms that there are significant First Amendment questions in this case. It is only fair that our clients have the necessary evidence to vindicate their constitutional rights. Therefore, we are pleased the Court recognizes the potential irreparable harm San Diego Unified has caused these families.

As part of its ruling, the Court narrowed down several proposed records requests, finding that they were “overly broad.” This included narrowing names and documents to those referenced in the preliminary injunction motion and tailoring the requests to focus exclusively on the Anti-Islamophobia Initiative’s policies and subsequent iterations, not to the case at large.

SDUSD must produce the records by April 9, 2018, which is the deadline for the district to file an opposition to the motion for a preliminary injunction. A hearing date on the motion is scheduled for April 23, 2018.
