Open Letter to Sheriff Villanueva: Keep ICE in LA County Jails!

Dear Sheriff Villanueva:

Do not remove ICE from the jails.

It is essential that county and state law enforcement work closely with your federal brothers and sisters.

Immigration and Customs Enforcement plays a vital role in many actions and efforts in LA County.

They fight sex trafficking, drug trafficking, human trafficking, and they ensure that transnational gangs do not gain a foothold in any part of the United States.

Please put aside your upsets, frustrations, and outrage over the Trump Administration. Public safety is about cooperation not competition with other branches of our republic.

There is nothing good that comes out of politicizing public safety and law enforcement.

Foreign nationals who commit crimes in Los Angeles County should be removed immediately! Retain ICE in the LA County jail system, and please put the safety of LA County residents FIRST!

Enforcement and Removal 03/01/2018 Share         232 illegal aliens arrested during ICE operation in Northern California https://www.ice.gov/news/releases/232-illegal-aliens-arrested-during-ice-operation-northern-california SAN FRANCISCO – U.S. Immigration and Customs Enforcement (ICE) deportation officers arrested 232 individuals for violating federal immigration laws in the San Francisco area of responsibility (AOR), extending from the Bakersfield area north to the Oregon border, during a four-day targeted operation that ended Wednesday. During the operation, ICE’s Enforcement and Removal Operations (ERO) arrested 232 individuals for violating U.S. immigration laws. Of those arrested, 180 were either convicted criminals, had been issued a final order of removal and failed to depart the United States, or had been previously removed from the United States and returned illegally. 115 had prior felony convictions for serious or violent offenses, such as child sex crimes, weapons charges, and assault, or had past convictions for significant or multiple misdemeanors. Arrests include: In San Leandro, a previously removed citizen of Mexico, who has criminal convictions of involuntary manslaughter and domestic violence. In Fresno County, a previously removed citizen of El Salvador, who has criminal convictions including assault with force. In Sacramento, a previously removed citizen of Mexico, who has criminal convictions of negligent discharge of a firearm and driving under the influence. In Fresno County, a previously removed citizen of Mexico, who has criminal convictions of battery on spouse and burglary. In Vallejo, a previously removed citizen of El Salvador, who has multiple criminal convictions for driving under the influence These arrests were driven by leads developed by the local field office in conjunction with the Pacific Enforcement Response Center (PERC) and with the National Criminal Analysis and Targeting Center (NCATC). ICE focuses its enforcement resources on individuals who pose a threat to national security, public safety and border security. However, ICE no longer exempts classes or categories of removable aliens from potential enforcement. All of those in violation of immigration laws may be subject to immigration arrest, detention and, if found removable by final order, removal from the United States. Some of the individuals arrested during this operation will face federal criminal prosecutions for illegal entry and illegal re-entry after deportation. The arrestees who are not being federally prosecuted will be processed administratively for removal from the United States. Those who have outstanding orders of deportation, or who returned to the United States illegally after being deported, are subject to immediate removal from the country. The remaining individuals are in ICE custody awaiting a hearing before an immigration judge, or pending travel arrangements for removal in the near future.  Recent legislation has negatively impacted ICE operations in California by nearly eliminating all cooperation and communication with our law enforcement partners in the state by prohibiting local law enforcement from contracting with the federal government to house detainees.     ICE has no choice but to continue to conduct at-large arrests in local neighborhoods and at worksites, which will inevitably result in additional collateral arrests, instead of focusing on arrests at jails and prisons where transfers are safer for ICE officers and the community. Ultimately, efforts by local politicians have shielded removable criminal aliens from immigration enforcement and created another magnet for more illegal immigration, all at the expense of the safety and security of the very people it purports to protect. Despite the severe challenges that this law creates for ICE, we remain committed to our public safety mission and we will continue to do our sworn duty to seek out dangerous criminal aliens and other immigration violators. Reminder: Employers in the United States Must Comply With Federal Immigration Laws

Just a reminder ....

The United States of America is a republican form of government, and the several states are required to comply with federa law, including immigration laws. The Tenth Amendment is an irrelevent counterpoint to this fact.

Someone needs to arrest California Attorney General Xavier Becerra--and I would recommend listing some of the gubernatorial candidates on that list, including Gavin Newsom and Antonio Villaraigosa.

For the employers in the state of California and across the country, they need to know the truth about the supremacy clause of the United States Constitution, and now that they have the encouragement as well as a mandate to enforce all immigration laws and cooperate with enforcement officials.

ICE PRESS RELEASE WORKSITE ENFORCEMENT 01/10/2018   Worksite enforcement targets employment law violators Ensuring each of its employees is legally authorized to work in the United States is one of many responsibilities facing every American business, from small start-up operations to our country’s largest and most prosperous corporations. Tasked with enforcing the business community’s compliance with federal employment eligibility requirements, U.S. Immigration and Customs Enforcement (ICE) Homeland Security Investigations (HSI) developed a comprehensive worksite enforcement strategy that targets employers who violate employment laws. This strategy incorporates  a three-prong approach to conduct worksite enforcement:compliance, through I-9 inspections, civil fines and referrals for debarment;enforcement, through the arrest of employers, knowingly employing undocumented workers, and the arrest of unauthorized workers for violation of laws associated with working without authorization; and outreach, through the ICE Mutual Agreement between Government and Employers (IMAGE) program, to instill a culture of compliance and accountability. “HSI prioritizes  violators  who abuse and exploit their workers, aid in the smuggling or trafficking of their alien workforce into the United States, create false identity documents or facilitate document fraud, or create an entire business model using an unauthorized workforce,” said HSI Acting Executive Associate Director Derek Benner. “Further priority is given to looking closely at those companies or industries that are deemed national security or critical infrastructure interests.”  From an operational standpoint, each worksite enforcement investigation is unique. Many factors are considered and, depending on the level of cooperation and culpability, the final outcome for the company and its employees will vary from case to case.  For example, a recently completed investigation of Asplundh Tree Experts Co., one of the largest privately-held companies in the United States, revealed a scheme to unlawfully employ aliens, in which the highest levels of Asplundh management remained willfully blind while lower level managers hired and rehired employees they knew to be ineligible to work in the United States.  The company pleaded guilty and was ordered to pay a monetary forfeiture judgment in the amount of $80 million – the largest judgment ever handed down in a worksite enforcement investigation.  They are also required to abide by an administrative compliance agreement, as set forth by HSI Philadelphia, the local jurisdiction for the company’s headquarters.  Pursuant to a separate civil settlement agreement, Asplundh will pay an additional $15 million to satisfy civil claims arising out of their failure to comply with immigration law, bringing the total cost of this illegal scheme to $95 million. An effective worksite enforcement strategy must address both employers who knowingly hire illegal workers, as well as the workers themselves. In worksite cases, ICE investigators adhere to high investigative standards, including the following: ICE will look for evidence of the mistreatment of workers, along with evidence of trafficking, smuggling, harboring, visa fraud, identification document fraud, money laundering and other such criminal conduct.  Worksite enforcement investigations often involve violations of other criminal statutes by employers and may also reveal widespread employee abuse. For example, many of the agency’s worksite investigations uncover instances of alien smuggling, alien harboring, document fraud, money laundering, or worker exploitation. HSI also investigates employers who use force, threats or coercion – such as threatening to have employees deported – to keep unauthorized alien workers from reporting substandard wages or unsafe working conditions. By uncovering such violations, HSI is sending a strong deterrent message to all industries that companies who knowingly hire unauthorized workers will be investigated resulting in possible civil or criminal penalties. Employers who are seeking assistance with ensuring their companies are compliant can seek Department of Homeland Security (DHS) certification through the IMAGE program. Participants have pledged to maintain a secure and stable workforce, including outreach and education designed to prevent unlawful hiring practices. After first completing a self-assessment questionnaire, employers must enroll in the DHS E-Verify program, establish a written hiring and employment eligibility verification policy and submit to a company-wide form I-9 inspection. As of Sept. 1, 2017, there are 114 charter members; four endorsees, which are associations who promote IMAGE requirements to their members; 287 certified members (certified after 2011); and 183 companies who have signed agreements and are in the process of becoming certified members.

This is incredible!

In spite of SB 54, the Sanctuary State legislation forced onto the state of California by lawless Democrats in Sacramento, individual jurisdictions are cooperating with ICE as much as they can.

Police departments can waive state laws which conflict with federal law, and they should. We are a constitutional republic, and as a nation of laws states have an obligation to comply with federal laws when the federal government enacts ordinances in full compliance with the United States Constitution.

Our local and state governments are obliged, required to comply with federal immigration laws. It's good to see San Gabriel doing the right thing and cooperating with ICE and the Department of Homeland Security.

More municipal governments must do the same. Urge your city to follow San Gabriel's bold, necessary example.

The agreement comes at a time when many California police departments, including Pasadena, are keeping their distance from ICE and its immigration enforcement activities. According to the MOU with San Gabriel, officers there may be forced to perform certain ICE duties, but the document does not explain what those duties are. San Gabriel Public Information Officer Jonathan Fu said the agreement “allows us to address crimes that negatively impact the quality of life for both immigrants and non-immigrants. The [police] department does not engage in immigration checks, round-ups, or deportations,”” Fu wrote in an email to the Pasadena Weekly. “We adhere to California law, which prohibits us from enforcing federal immigration policies.” Sixty-one percent of the residents in San Gabriel are of Asian descent, according to the latest US Census figures. Of the city’s 40,400 residents, 25 percent are Latino. The MOU between the two parties comes on the heels of declarations by many California police departments including, Pasadena and Los Angeles, disavowing cooperation with ICE. Last February, Pasadena City Manager Steve Mermell voided a reimbursement agreement between police and ICE after discovering he never signed the three-month-old document. Mermell made the move as many called on city officials to declare Pasadena a sanctuary city — which protects residents living in the country without documentation from ICE. The city adopted a policy prohibiting city officials from discussing immigration status, but stopped short of declaring itself a sanctuary city. Pasadena Police Chief Phillip Sanchez has reiterated several times that his officers do not enforce immigration laws, and officers do not check immigration status when making contact with civilians. During his campaign, President Donald Trump threatened to slash federal funding from so-called sanctuary cities. In June, a federal judge ruled that Trump could not withhold that funding.
