MassResistance Reports on My False Arrest

Left-wing judge, local public officials viciously target MassResistance activist Arthur Schaper for demanding that a California city follow state and federal immigration law.

Across America (and certainly in California) we’ve all seen Antifa-type thugs do horrible things and get away with it. They shut down conservative speeches and events, assault conservatives in restaurants and even at their homes, block traffic, destroy property, and threaten people at will. It’s become almost commonplace. The scenes of lunatic liberals screaming and near-rioting at the recent Kavanaugh hearings will remain embedded in our minds. But nothing happens to them.
We commonly see how police routinely stand aside and mostly just watch when these things happen. On the extremely few occasions when the perpetrators are arrested, it’s basically a sham and they’re rarely punished. They simply stroll through the court system and out the door.
But with conservatives, it’s becoming just the opposite. Part of the political arsenal of many left-wing officials, prosecutors, and judges is to use the slightest infraction – real or imagined – to oppress conservatives. It’s not just cake bakers or wedding photographers anymore, but now they’re trying to target political activism that they don’t like.
One of the things that MassResistance believes – which America’s founders implored in their writings – is that when government blatantly breaks the laws it is the duty of citizens to stand up to them. In fact, it’s necessary for a free society to work. This drives the Left crazy!

Huntington Park, CA – more than just a “sanctuary city”

Huntington Park, CA, a suburb of Los Angeles, is controlled by a left-wing city council and mayor. It has a history of illegal “social justice” activism and political corruption that upsets many of the local citizens.
Back on August 3, 2015, the Huntington Park City Council went beyond just being a “sanctuary city.”  It appointed two illegal aliens as city commission members. That is against state and federal law. Even CA Gov. Jerry Brown – a liberal – recently vetoed a bill that would have opened up boards to non-citizens (though not illegal aliens).
This took place approximately three years before Arthur became Organizational Director of MassResistance. At the time he was a member of We the People Rising, a local group opposed to illegal immigration. (The group actually has many Hispanic, black, and Asian members!)

Starting in 2015, the group comes to protest

Starting on August 17, 2015, Arthur and other We the People Rising members attended the Huntington Park City Council meetings and spoke against the appointment of the two illegal commissioners. They were often heckled and harassed by organized pro-illegal immigration activists, but they continued to come and speak.

The Mayor and City Council members, in particular, were angry that they faced repeated challenges from citizens. They reacted by illegally harassing Arthur and the other members:
City council illegally throws Arthur and another man out of meeting.On September 8, 2015, Arthur was thrown out of the city council meeting for simply asking the council if audience members could speak. On October 6, 2015, another man, a doctor sitting in the audience, exclaimed “Yes” while Arthur was addressing the council – and got thrown out.  Subsequently, the Los Angeles County District Attorney’s office notified the city council that the city had broken state law in throwing the two men out of the meeting.
City council illegally interrupts Arthur’s speech. On Feb. 15, 2016, Arthur was reading a recall petition to the city council. But the mayor continuously interrupted him because he was not speaking about the agenda item. The mayor also allowed the audience to shout and interrupt him, to a point where no one could hear him speaking. Subsequently, the LA County District Attorney’s office notified the city council that Arthur had a legal right to speak on any subject he chose,and the city had no right to suppress his speech.
In those letters, the district attorney’s office referred to the Brown Act, a California state law which gives members of the public broad rights to attend public meetings and address the officials.
And there were more violations. At one point the city also tried to deceive the public by calling an “emergency” meeting without giving an agenda – which is clearly illegal – and the DA’s office cited them for that, also.
The law does allow the city to have people removed for disruptive behavior if first given a warning. The city council routinely ignores the disruptive behavior of people who agree with them, but vigilantly removes dissenters.

On June 6, 2017, Arthur and We the People Rising came to the city council meeting with a larger group than usual – including many blacks and Hispanics. However, word had gotten out and they were met with an equally large group of thuggish pro-illegal immigration activists who also came to the meeting to oppose and oppress them.

One source in the city informed Arthur that the activists were going to every length to target Arthur personally at the meeting. As the meeting began, that clearly was happening.
It was a very contentions and heated situation. There was about an hour of testimony from both sides, peppered with outbursts and name-calling (mostly from the Leftists, and much of it was directed at Arthur).

A particularly strange aspect to the name-calling was that the pro-amnesty activists kept repeating the mantra that Arthur's group members were anti-Mexican and anti-black racists. But many of those in Arthur's group who were there testifying were pro-family Mexicans and blacks.
As the meeting proceeded, the council allowed most of the clapping and shouting to pass, but announced that anyone given two warnings for disruptive behavior would be ejected. A few people were particularly loud and after two warnings they were forced to leave.

Arthur gets targeted …

During the meeting, Arthur made it a point not to make any disturbances and was quite subdued, as videos of the meeting and eyewitness accounts attest.
Nevertheless, at one point during the general commotion some members of the group of amnesty activists started loudly shouting "Shut up, Arthur! Shut up Arthur!" even though Arthur was not saying anything. They were also screaming and cursing at Arthur. The Mayor heard the shouts, and simply declared that Arthur was being disruptive. Without any “warning” the Mayor ordered the police to order Arthur to leave.

What happened next was very odd. When the police who were in the room came and told Arthur to leave, he replied that he had made no disturbance and had done nothing wrong, and was staying. (Constitutional law free-speech organizations will often advise people not to obey similar orders from police that obviously illegal. Arthur noted the letters from the district attorney’s office, and state law, about the rights of citizens at public meetings.) The police balked and did not confront Arthur. As they later testified, none of them had witnessed Arthur making any disturbance.
Then the mayor used a different tactic. She told the police to clear the room of everyone. Arthur still refused to leave, realizing the true purpose, and the police arrested him and took him away. Several other people on both sides also did not leave the meeting room, but the police only arrested Arthur and left all the others alone.

After Arthur was taken out, the people who had left the room were allowed back in and the meeting continued.
Arthur was subsequently charged with catch-all misdemeanors -- “resisting, delaying, or obstructing a peace officer” and “disturbing the peace.” (The latter was later dropped.)
But this was just the beginning of a greater nightmare, as the “criminal justice” system was to be used as a club to harass and punish Arthur as severely as possible for his political opinion.

Schaper vs. The City of Huntington Park: Report

On Tuesday, February 22, 2018, I attended a small claims hearing in my action against the city of Huntington Park.

My small claims suit was a result of multiple infringements of my rights, including false arrest, violations of the state's open meeting laws, as well as constitutional violation of my First Amendment rights to petition the government for a redress of grievances.



On June 6th, 2017, the Huntington Park City council unjust ruled me out of order, then ordered my removal from the city council chambers.

The police ordered me to leave, even though they had not given me a lawful order in any way. Other people in the room were disruptive, loud, yelling, shouting. A number of people had shown up to the meeting precisely to harass me and others. It was really shameful what these left-wing Brown Supremacists and their enablers think that they can get away with.

The city council happily obliged with their hate, and the Sergeant at arms and chief of police wrongly accused me of disrupting the meeting.

Fast forward nine months later, and I am in small claims court at Downey Courthouse. I had no idea what to expect, especially because the LA County DA's office has chosen to pursue charges, citing Penal Code 148(a)(1), although it's not clear how exactly a delayed a police order from fulfilling his duty. They had neither duty not right to arrest me that day.

At any rate ...

The presiding officer was Commissioner Michael Pearce, an naturalized citizen from England who had served as an attorney in the Long Beach for twenty years. Department SE2 was filled with defendants and plaintiffs. I was really surprised to see so many legal actions sought for this small courtroom.

Fourteen witnesses for my case arrived. I am so happy that so many people were willing to stand u for what is right and testify on my behalf against the corrupt city council and the police who had me falsely arrested. When we all entered the courtroom, some people had to sit in the jury box, since there was no room left in the audience. One group sat on the right side so that they could receive translations of the court proceedings in Spanish or Korean.




Friends and supporters from Santa Clarita and La Crescenta also arrived to show support.

Then I saw Huntington Park Police Chief Cosme Lozano with an attorney. He was going to represent the city of Huntington Park. Really? What were they thinking? The city must be desperately trying to run away from this travesty that they created. They knew that they had no right to arrest me, and they didn't want to see their names dragged through the mud because of their lawless actions.

Cosme Lozano? Really?!



I had to deal with him and his lawyer within five minutes of court opening up for session. The city clerk informed us that we needed to take whatever steps possible to resolve the matter. I informed the attorney that I wanted the following:

1. The city would acknowledge their wrongdoing, that they had no right to call me out of order and remove me from the city council chambers.

2. They would pay the $10,000 indemnity for violating my civil rights and placing me under false arrest.

3. They would remove the two illegal aliens from the city commissions.

With arrogant disdain, Lozano told me that those terms were unacceptable and he would go to court and make the case before the judge. By the way, I discussed this settlement with all 14 of my witnesses surrounding us. I wanted the lawyer and the chief of police to understand that I came prepared to make my case. Lozano and the attorney walked back into the courtroom, but then I told him to come back outside because we must have an exchange of evidence, i.e. discovery.

From that point on, the chief of police understood that I was not going to tolerate his disrespect or allow him to get away with his egregious disregard for the rule of law.

I was really surprised how quickly my case was called up. I was the second plaintiff to  make my case to the judge. He was patient and willing to listen, but had to remind me to mind the time that I was taking, since there were at least 20 other small claims which he needed to hear.

I read from an extended statement which I had printed. I highlight the unjust rulings out of order, my false arrest, the emotional distress of being arrested and incarcerated, and the harassment I had endured from the police department because they had served me multiple notices to appear and never actually filed the criminal package with the DA's office. Moreso, I informed the commissioner that the city has a history of Brown Act violations, and I had provided the letters from the DA's Public Integrity Division on these matters. On June 6th specifically, the Lieutenant lied to the audience, not allowing us to enter the city council chambers at the outset, then lied when he informed us that the seats were at capacity.



When the commissioner asked if I had witnesses, I signalled to everyone to raise their hands. Pearce said he would lead the trial, and he instructed all of them to sit in the jury box. It was an impressive array of justice against the corrupt city council and the police chief.

One of the witnesses, Gary Gileno, would tell me after the trial that Cosme did not look comfortable at all. He grimaced the entire time that I was presenting my case, including a flash drive with my videos and also another flash drive prepared by Gary Gileno.

Commissioner Pearce then told me to call up the three most pertinent witnesses, and I joked to everyone else: "Sorry everybody. Please don't take offense."

I called up Robin Hvidston, Gary Gileno, and Rudy Cruz.

Each of them testified that they were surprised, shocked that I had been called out of order. They could not believe it. Gary added that because Cosme Lozano was seated at the front of the city council chambers, there was even lesser likelihood that he would have heard anything.

Rudy Cruz testified that there were people behind me harassing me. I stated twice that people behind me were giving me a hard time, yelling at me, and the security on scene did nothing about it. On top of that, I provided statements of declaration from seven witnesses, so that the presiding officer could look them over.

In contrast, Cosme Lozano put forward the government code, then the rules of decorum, then gave the commissioner a CD with different videos on it. His case was rather weak. When the commissioner questioned him about what exactly I had done to merit my being ruled out of order, he tap-danced around the issue, had nothing to say to substantiate it. He often made references to the fact that the meeting was filled with noise and disruption. To which one has to add: why was I targeted and then arrested?

Lozano then let slip that the District Attorney declined to prosecute me for the 403 charge, disrupting a public meeting, because LOTS of people were disrupting the meeting! OOPS!

The People vs. Arthur Schaper--Downey Courthouse Update

                                 

Hey everyone.

I am giving everyone a full update regarding my criminal trial at Downey Court House.

In an unexpected turn, I was assigned to another public defender because of structural staffing changes within the Downey office.

Then on the day of the February 9th, 2018 pre-trial hearing, the new defender told me that another conflict of interest was found, so I had to wait for a bar panel attorney.

I ended up waiting in Department 4 for nearly four hours. Finally, my attorney arrived, ready to handle my case.

I am still pleading not guilty, and I am not accepting any plea deals. What the Huntington Park city council and the police department did to me was wrong, corrupt, and vile.

We are going to have our day in court.

I must say, there is some joy in knowing that I can go to a criminal court hearing and not feel stressed or fearful. Gary "Grindall61" Gileno knows what this process can be like. Now that his case continues to be postponed and continued, I am getting a similar taste of how slow the wheels of justice really move in Los Angeles County.

The presiding judicial officer, Commissioner May Santos, was prepared to go through arraignments and plea deals, but the whole calendar was suddenly disrupted by a de novo small claims hearing. That set back her calender by about 45 minutes.

Oh well. These sudden changes in court business are more common than most people realize. I served as an intern with the Orange County public defenders office a number of years ago. These setbacks happen all too often.

It was astonishing to me how many people showed up who were supposed to have proof of completion and restitution as part of plea deals which they had taken to avoid jail times. One young man had taken off two years and not completed any community labor requirements or restitution! I could not believe the massive amounts of leniency from the judicial officer.

I imagine that judges do not remand a number of defendants out on probation because there is simply no room for them in the county jails. The state's fiscal predicaments are so dire, that courts have been closed throughout the state, and in some countries there are long lines and continuances upon continuances for low-level crimes.

I get arrested just for sitting in a city council meeting, so it's no surprise that courts are pushing back trial hearings over and over. This is beyond ridiculous. I am urging that my new attorney file a motion to dismiss as soon as possible. This corrupt action from the Huntington Park City Council and Police Department is beyond ludicrous, and a full determination for our corrupt the leadership in the city has become.

UPDATE: Sanctuary City Has Me Arrested, Refuses to File With DA, Sends Multiple Notices to Appear

The city of Huntington Park disregards the rule of law. They do not honor our immigration laws, and the city council routinely hands out taxpayer dollars and contracts to political friends and cronies at the expense of the taxpaying citizens.



City residents have declared on record their frustration with the Huntington Park police department. At one city council meeting, two people told the city council that they had been unjustly arrested and fined for crimes that they did not commit.

Why does that sound familiary?

Oh, yeah, that's right--I was arrested in Huntington Park for doing ... what exactly?

Doing nothing wrong, that's for sure.

Sergeant Joseph Settles "warned" me to stop disrupting the meeting, when I wasn't disrupting the meeting.

Then Chief of Police Cosme Lozano suggested one ruling for me as out of order.

Then someone behind me lied, claiming that I had already been ruled out of order.

HUH?

Outrageous! The city of Huntington Park has a nasty habit of throwing people out of meetings for no good reason, and this time I could not let the city just arbitrarily toss me out.

I didn't disrupt the meeting!

One would think that the Huntington Park Police Department would go to great lengths to ensure my prosecution, right?

After all, they searched and took away my personal effects, they fingerprinted me and took my headshot.

They made me stay in a jail cell for two hours.

Then they released me with a citation:

Then, guess what? I get an email from Lieutenant Patrick Kraut four hours after I went to the Downey Courthouse:

Wow! Talk about rude and disrespectful! Not even four hours after appearing at the Downey Courthouse, I get this email telling me that the date for my court appearance has changed.

I was astounded that the Huntington Park police department couldn't bother to file anything with the District Attorney's office in the last three months. Would it really have taken them that long?

I confronted the Huntington Park Chief of Police about this matter.

Granting them (somewhat) the benefit of the doubt, I attended the next scheduled court date.

And guess what?!

Then, wow, get this!

I get a further notice of correction from the Huntington Park Police Department:



What is the matter with this corrupt city?

They have me arrested for no reason. They allow illegal aliens to sit on city commissions, too, and they let the police department run rampant.

Their code enforcement officers don't enforce the municipal codes. The trash company in the city does not pick up the trash in the city, either.



What are people paying taxes to the city for if they city is not ensuring that the basic necessities of the city get taken care of?

This is the lawlessness which engulfs sanctuary cities, and Huntington Park is about to get a hard dose of the rule of law very soon.

We have one rule of law in this country, and I refuse as a private citizen to tolerate the abuse and disregard of our nation's immigration laws and my constitutional rights.

BREAKING: Trump Supporter Files Lawsuit Against Sanctuary City for Civil Rights Violations






BREAKING:


I have officially filed a small claims action against the City of Huntington Park for false arrest, violation of my civil rights, emotional distress, defamation of character, and harassment.


All of this follows from their false arrest of me on June 6th, 2017 when they cited me for disturbance of a public meeting and failing to follow the lawful order of a peace officer.

I did not disrupt the meeting--and the order from the officer was unjust.

Incompetence: Huntington Park Police File Late Police Report with Court

OK ...

So what happened to me at Downey Courthouse on September 6th?

I was scheduled to appear in court because of a citation following my arrest on June 6th, 2017 in the Huntington Park City Council.



I was cited for PC 148(a)(1) and 403.

I showed up at the court house, and my name was not on the criminal calendar!

What is going on?

Hey, at least I did appear as instructed, and I received a certificate of appearance, too.

Then, about four hours later, I received the following email:

Mr. Schaper,

I would like to inform you that our agency has submitted a Notice of Correction and Proof of Service for citation HP169301, noting a change in court date.  The court date reflected on your citation is being changed from 09-06-17 to 10-xx-17 [I will reserve this information for a later date].   A copy of the Notice of Correction and Proof of Service has been mailed to your residence as of this morning.  If you have any questions, I can be reached at the below listed contact number and email.

Really?!

Notice that the email went out at 12:03pm ...

LOL!

They had three months to file the paperwork with the district attorney's office.

Three months. They couldn't take 15 minutes out of the day from anyone of the staffers in the police department to file the case?

Really?! Uh ... NOPE!

The original notice I had received told me to go to court at 8:30am, earlier that day.

This is the best that the Huntington Park police department can do?

I called Lieutenant Kraut within 15 minutes of receiving this email (and I will be receiving an official letter from them, too, regarding this correction).

He apologized, since he had been out of the office, and he regretted that he had not given me this notice sooner.

Really?!

Oh please. This is a petty move by highers-up to try and give me a hard time.

There is no case here, folks. This action was a brazen disregard of the rule of law, to have me arrested when I was not out of order or disrupting the meeting in any way. Frankly, I believe that the Huntington Park Sergeant at Arms and the chief were crapping in their pants because I refused to leave when ordered to. They had no right or standing to do so.

Now they have to pay the price.

And just three days prior, two more Huntington Park residents complained to the city council about unjust actions against them because of the ... wait for it ... Huntington Park police department.

OOPS!

They want to mess with me and other freedom-loving citizens because they placed me under false arrest?

Sad.

Either way, I intend to stand for my rights--just as many people before us have done.
