My Statement to Downey Small Claims Court: Arthur Schaper vs. City of Huntington Park

Here are the notes and the statements I used in my small claims against the city of Huntington Park, where the presiding officer had me unjustly ruled out of order, followed by my false arrest, incarceration, and the harassment which followed.




Please find the statement below:


Good morning, Your Honor.

My name is Arthur Schaper, and I am suing the city of Huntington Park for the following reasons:
1.       Violating my civil rights, specifically to attend an open meeting per the Ralph M. Brown Act
2.       Unjustly calling me out of order during a city council meeting, when I had not disrupted the meeting, and especially compared to the majority of people in the audience.
3.       False arrest: I was placed under arrest because I did not comply with an unlawful order, based
4.       Emotional distress, since I was arrested in full view and forced to under search and seizure following the unjust arrest.
5.       Harassment, because the Huntington Park Police Department issued to me multiple notices to appear, only to inform of notices of correction at the last minute. They deliberately refuse to file criminal charges against me until I filed this lawsuit.

On June 6th, 2017 I was attending the Huntington Park City Council meeting. In fact,  I and many people were forced to wait in the lobby of the first floor of the city hall with many others. The Lieutenant presiding over the first floor, Lieutenant Alfred Martinez, lied to the public, claiming that the chambers was at capacity.



No it was not. I have witnesses—Robin Hvidston and Robert Lauten—who will attest that there was still plenty of room in the city council chambers. I went up on my own, and I found that there was indeed plenty of space.

I sat down in the city council chambers to hear the meeting. People were laughing or making side remarks. One man was seated behind me, constantly yelling out “Shut up, Arthur!” Another woman was flashing a light in my face.

At one point, Sergeant Joseph Settles approached me and told me to stop disrupting the meeting. I asserted myself and informed him that I was not speaking out of turn in the chambers, nor was I preventing anyone near me from hearing the speakers during public comment.

I asked two security members behind me to address the disruptions of the individuals behind me. Neither one of them did anything about it.

At one point, following the public comment from Rudy Cruz, Chief of Police Cosme Lozano indicated somewhat evasively that I was “seemingly out of order”. Mayor Marilyn Sanabria ruled of out order. Then someone in the back of the room—the same people who had been yelling at me and harassing me—that I had already receive a warning.

The mayor looked puzzled, asked the audience if that was true. And when people in the audience shouted “yes”, she ordered the police to have me escorted out.

I calmly said to Sergeant Settles that I had not disrupted the meeting, I have a right to be there, and that I ma not leaving.

He pressed on me further, stating “I am giving you a lawful order.” With all due respect, it was an unlawful order, and I am not bound, nor is any other citizen bound to do whatever a police officer says. I have witnesses who will testify that people were trying to find some way just to get me thrown out of the meeting, whether justly or not. Not only that, but there was another gentleman in the city council chambers who had received three warnings before being escorted out. Why this inconsistent enforcement?

Eventually, without recourse or rule of law, Sergeant Settles placed me under arrest. I was arrested for sitting in a city council meeting.

Even as I was escorted out of chambers, I repeated: “I did not disrupt the meeting.”

I was escorted to the city jail, where I was searched, my properties were taken from me. I was then forced to sit in a jail cell for two hours after getting fingerprinted and registered.

I received a notice to appear in court September 6th, 2018, then I was released.

I filed a government claim against the city for false arrest and violation of my civil rights. They rejected my claim.

I appeared in court September 6th, and noticed that my name was not on the criminal calendar. I didn’t know what was going on. I did obtain a certificate of appearance. I then received an email four hours later from Lieutenant Patrick Kraut, indicating notice of correction. I didn’t understand why they would give me a notice to appear, yet not have a criminal package filed with the DA’s office.

The next notice appear was for October, and I appeared that day, and once again my name was NOT on the calendar. This is tantamount to harassment. Regardless of the statute which gives police departments a year to file on these charges, they insisted on mailing me notices of correction instead of filing the criminal package with the DA's office.

I finally decided to sue the city, which brings me here, and then they issued a fourth notice of correction and to have me appear in court on December 18th. How can it possibly take a police department six months to file a criminal package on a misdemeanor charge? I confronted the Chief of Police about this and he just ran away from me!

It’s ridiculous.

Your honor, I submit to you that the police department did not want to file because they know they had no right to call me out of order or have me arrested.

I further submit to you that the city council attempted to cover up their unjust rulings against me. I have the minutes for the June 6th meeting, in which they claim that I was called out of order, then claim in the minutes that I continued to be disruptive, and for that reason I received a second warning.

That is not what happened. Your honor, the city council lied on their minutes and approved them. I have video from three different people in the meeting, including myself, plus the official City Council recording through Granicus. I have two witnesses here, Robin Hvidston and Gary Gileno, will confirm that I was not disruptive in the meeting.



Even if for whatever reason they city councilman and police officers were justified in calling me out of order—and they were not—I had only received one warning, and there was lots of noise and disruption going on in the city council chambers. Why were they not called out of order?
Not only that, your honor, but the Mayor calmly decided to accept what other people shouted about me in the meeting, when also she had to do was check the minutes taken by the city clerk, and she would have confirmed to the presiding officer that there was only one warning—and even that warning was unjustified.

On top of that, the city council has a history of Brown Act violations against me and others. I have letters from the public integrity division of the LA County DA’s office to confirm this.
I have numerous witnesses here and now who will testify that I did not disrupt the meeting, that the police had no right to order my removal or to place me under arrest.

I had every right to attend this meeting, the city and its police officers on scene had no right to remove me. I urge your honor to ensure that our rights as citizens remain protected, that we prevent arbitrary rulings against attendees in any public meeting from being called out of unjustly and placed under false arrest—just for attending a public meeting.

Not only that, but they seized my phone without cause. I had to return to the city police department to retrieve my cellphone. They had no right to take it, and I imagine that the judge rebuffed any effort for them to break into my phone. The police department had no probable cause to seize the phone.

Again, it was an unlawful order to have me ruled out of order, then to have me placed under arrest. I have witnesses who will testify that in the past they refused to comply with similar unlawful orders from the police department—and they were not placed under arrest.

Also, the same presiding officer called me out of order for NO REASON in the June 20th meeting, which to me shows another pattern of abuse and selective enforcement.

Schaper vs. The City of Huntington Park: Report

On Tuesday, February 22, 2018, I attended a small claims hearing in my action against the city of Huntington Park.

My small claims suit was a result of multiple infringements of my rights, including false arrest, violations of the state's open meeting laws, as well as constitutional violation of my First Amendment rights to petition the government for a redress of grievances.



On June 6th, 2017, the Huntington Park City council unjust ruled me out of order, then ordered my removal from the city council chambers.

The police ordered me to leave, even though they had not given me a lawful order in any way. Other people in the room were disruptive, loud, yelling, shouting. A number of people had shown up to the meeting precisely to harass me and others. It was really shameful what these left-wing Brown Supremacists and their enablers think that they can get away with.

The city council happily obliged with their hate, and the Sergeant at arms and chief of police wrongly accused me of disrupting the meeting.

Fast forward nine months later, and I am in small claims court at Downey Courthouse. I had no idea what to expect, especially because the LA County DA's office has chosen to pursue charges, citing Penal Code 148(a)(1), although it's not clear how exactly a delayed a police order from fulfilling his duty. They had neither duty not right to arrest me that day.

At any rate ...

The presiding officer was Commissioner Michael Pearce, an naturalized citizen from England who had served as an attorney in the Long Beach for twenty years. Department SE2 was filled with defendants and plaintiffs. I was really surprised to see so many legal actions sought for this small courtroom.

Fourteen witnesses for my case arrived. I am so happy that so many people were willing to stand u for what is right and testify on my behalf against the corrupt city council and the police who had me falsely arrested. When we all entered the courtroom, some people had to sit in the jury box, since there was no room left in the audience. One group sat on the right side so that they could receive translations of the court proceedings in Spanish or Korean.




Friends and supporters from Santa Clarita and La Crescenta also arrived to show support.

Then I saw Huntington Park Police Chief Cosme Lozano with an attorney. He was going to represent the city of Huntington Park. Really? What were they thinking? The city must be desperately trying to run away from this travesty that they created. They knew that they had no right to arrest me, and they didn't want to see their names dragged through the mud because of their lawless actions.

I had to deal with him and his lawyer within five minutes of court opening up for session. The city clerk informed us that we needed to take whatever steps possible to resolve the matter. I informed the attorney that I wanted the following:

1. The city would acknowledge their wrongdoing, that they had no right to call me out of order and remove me from the city council chambers.

2. They would pay the $10,000 indemnity for violating my civil rights and placing me under false arrest.

3. They would remove the two illegal aliens from the city commissions.

With arrogant disdain, Lozano told me that those terms were unacceptable and he would go to court and make the case before the judge. By the way, I discussed this settlement with all 14 of my witnesses surrounding us. I wanted the lawyer and the chief of police to understand that I came prepared to make my case. Lozano and the attorney walked back into the courtroom, but then I told him to come back outside because we must have an exchange of evidence, i.e. discovery.

From that point on, the chief of police understood that I was not going to tolerate his disrespect or allow him to get away with his egregious disregard for the rule of law.

I was really surprised how quickly my case was called up. I was the second plaintiff to  make my case to the judge. He was patient and willing to listen, but had to remind me to mind the time that I was taking, since there were at least 20 other small claims which he needed to hear.

I read from an extended statement which I had printed. I highlight the unjust rulings out of order, my false arrest, the emotional distress of being arrested and incarcerated, and the harassment I had endured from the police department because they had served me multiple notices to appear and never actually filed the criminal package with the DA's office. Moreso, I informed the commissioner that the city has a history of Brown Act violations, and I had provided the letters from the DA's Public Integrity Division on these matters. On June 6th specifically, the Lieutenant lied to the audience, not allowing us to enter the city council chambers at the outset, then lied when he informed us that the seats were at capacity.



When the commissioner asked if I had witnesses, I signalled to everyone to raise their hands. Pearce said he would lead the trial, and he instructed all of them to sit in the jury box. It was an impressive array of justice against the corrupt city council and the police chief.

One of the witnesses, Gary Gileno, would tell me after the trial that Cosme did not look comfortable at all. He grimaced the entire time that I was presenting my case, including a flash drive with my videos and also another flash drive prepared by Gary Gileno.

Commissioner Pearce then told me to call up the three most pertinent witnesses, and I joked to everyone else: "Sorry everybody. Please don't take offense."

I called up Robin Hvidston, Gary Gileno, and Rudy Cruz.

Each of them testified that they were surprised, shocked that I had been called out of order. They could not believe it. Gary added that because Cosme Lozano was seated at the front of the city council chambers, there was even lesser likelihood that he would have heard anything.

Rudy Cruz testified that there were people behind me harassing me. I stated twice that people behind me were giving me a hard time, yelling at me, and the security on scene did nothing about it. On top of that, I provided statements of declaration from seven witnesses, so that the presiding officer could look them over.

In contrast, Cosme Lozano put forward the government code, then the rules of decorum, then gave the commissioner a CD with different videos on it. His case was rather weak. When the commissioner questioned him about what exactly I had done to merit my being ruled out of order, he tap-danced around the issue, had nothing to say to substantiate it. He often made references to the fact that the meeting was filled with noise and disruption. To which one has to add: why was I targeted and then arrested?

Lozano then let slip that the District Attorney declined to prosecute me for the 403 charge, disrupting a public meeting, because LOTS of people were disrupting the meeting! OOPS!

Brady Violation Complaint Against Huntington Park Police Department Officers

To Chief of Police Cosme Lozano:

My name is Arthur Schaper, a resident of Torrance, CA and an active member of We the People Rising, LA County for Trump, and American Children First.
I am filing this formal complaint against the following police officers of the Huntington Park Police Department.

1. Yourself, Chief of Police Cosme Lozano
2. Lieutenant Alfred Martinez Badge #: 5529
3. Sergeant Joseph Settles, Badge #:5200

Alfred "Full Capacity" Martinez


1. On June 6th, 2017, Lieutenant Alfred Martinez informed a large crowd of individuals who wanted to attend the city council meeting that the city council chambers was “at full capacity”, meaning that there was no room for any more people to sit in the city council chambers.

Statements from individuals inside the chambers informed me and others by text as well as with photos that there were indeed more chairs available. The Lieutenant clearly misled the citizens in the lobby. Such dishonesty must be confronted and censured.

2. During the same meeting, I was wrongly ruled out of order due to the unfounded allegations of Sergeant Joseph Settles, who had alleged that I was disrupting the city council meeting in session at that time.

The mayor, Marilyn Sanabria, followed your suggestion to issue me a first warning.

Another member of the audience—Tlaleac Oceotl--called out to the mayor, saying that I had already received a warning, which would make Chief Lozano and Settles’ warning my second warning—even though I had not received any warning at the time.

The mayor then ordered my removal from the city council chambers. For the record, neither you, nor Sergeant Settles, nor Mayor Sanabria ruled Tlaleac him out of order for the numerous times he was shouting out, especially when he was telling me to shut up. Furthermore, I had spoken to two police agents at the back of the room that two people behind me were cursing at me and shining a light in my eyes, but your officers did nothing about it.



I refused to leave the room because every citizen has a right to attend public meetings per the Ralph M. Brown Act, and no citizen is required to give up his First Amendment rights due to unjust, unlawful orders from police officers. The members of my group and other activists have routinely disobeyed unjust orders from Huntington Park police officers in the chambers, which have included demanding that we lower or remove signs, or that we sit down when more than one of our members has stood at the podium during public comment.

Sergeant Settles ordered me to leave, then surrounded me with other officers, trying to pressure me to leave. Then I was unjustly placed under arrest, subjected to a demeaning search, placed in hold in the Huntington Park jail cell for two hours, then released.

At no time did I receive a booking number of a bracelet. From police sources, I find this practice highly questionable. It’s as though the police department had no interest in filing a police report or seeking charges against me from the DA’s office, since the common practice in police departments is to provide both and then send charges to the DA.

To add insult to this unjust injury, the negligent Police Department refused to file the paperwork with the Los Angeles County District Attorney’s office, even though I was ordered to appear in court on September 6, 2017.

This is clearly a negligent, abusive tactic, as I appeared at the Downey, CA Court house in a timely manner on the assigned court date, only to find that my name was not listed on the Criminal Court Calendar.

These abusive behaviors warrant redress, censure, and consequences:

1. The unfounded allegations for me to be ruled out of order during the June 6th, 2017 city council meeting
2. My unfounded arrest and incarceration
3. The illegal seizure of my cellphone
4. The noncompliance of the police department to file charges against me to the LA County DA’s Office
5. The violation of my civil rights, including the attempt to prevent me and others from attending the June 6th, 2017 City council meeting, then the assault on my First Amendment right to petition my government for a redress of grievances.

All of these actions are the results of the unethical behaviors and choices of the Huntington Park Police Department, particularly the three police officers listed above.

For these reasons, I am seeking a Brady Violation strike against all three.

#WINNING: Citizen Files Notice to Appear at Sanctuary City Clerk's Office

                     

I have had my small claim officially served to the city of Huntington Park.

My process server, John Willis of Ontario, served the notice to appear, informing the city that I was seeking a civil action against them for the following reasons.



1. Their false arrest of my on June 6th, 2017.
2. The emotional distress
3. Defamation of character
4. Violation of civil rights
5. Harassment from the Huntington Park police department

UPDATE: Sanctuary City Has Me Arrested, Refuses to File With DA, Sends Multiple Notices to Appear

The city of Huntington Park disregards the rule of law. They do not honor our immigration laws, and the city council routinely hands out taxpayer dollars and contracts to political friends and cronies at the expense of the taxpaying citizens.



City residents have declared on record their frustration with the Huntington Park police department. At one city council meeting, two people told the city council that they had been unjustly arrested and fined for crimes that they did not commit.

Why does that sound familiary?

Oh, yeah, that's right--I was arrested in Huntington Park for doing ... what exactly?

Doing nothing wrong, that's for sure.

Sergeant Joseph Settles "warned" me to stop disrupting the meeting, when I wasn't disrupting the meeting.

Then Chief of Police Cosme Lozano suggested one ruling for me as out of order.

Then someone behind me lied, claiming that I had already been ruled out of order.

HUH?

Outrageous! The city of Huntington Park has a nasty habit of throwing people out of meetings for no good reason, and this time I could not let the city just arbitrarily toss me out.

I didn't disrupt the meeting!

One would think that the Huntington Park Police Department would go to great lengths to ensure my prosecution, right?

After all, they searched and took away my personal effects, they fingerprinted me and took my headshot.

They made me stay in a jail cell for two hours.

Then they released me with a citation:

Then, guess what? I get an email from Lieutenant Patrick Kraut four hours after I went to the Downey Courthouse:

Wow! Talk about rude and disrespectful! Not even four hours after appearing at the Downey Courthouse, I get this email telling me that the date for my court appearance has changed.

I was astounded that the Huntington Park police department couldn't bother to file anything with the District Attorney's office in the last three months. Would it really have taken them that long?

I confronted the Huntington Park Chief of Police about this matter.

Granting them (somewhat) the benefit of the doubt, I attended the next scheduled court date.

And guess what?!



YEP!

My name wasn't on the calendar AGAIN!

This is ridiculous.

Then, wow, get this!

I get a further notice of correction from the Huntington Park Police Department:



What is the matter with this corrupt city?

They have me arrested for no reason. They allow illegal aliens to sit on city commissions, too, and they let the police department run rampant.

Their code enforcement officers don't enforce the municipal codes. The trash company in the city does not pick up the trash in the city, either.



What are people paying taxes to the city for if they city is not ensuring that the basic necessities of the city get taken care of?

This is the lawlessness which engulfs sanctuary cities, and Huntington Park is about to get a hard dose of the rule of law very soon.

We have one rule of law in this country, and I refuse as a private citizen to tolerate the abuse and disregard of our nation's immigration laws and my constitutional rights.

Reminder: Huntington Park Police STILL Won't File My Arrest with DA

Sorry, everyone.

I have had a lot going on for the last few weeks.

Good things have turned into better, and so much winning has been taking place, that it's hard to keep up.

All the Establishment RINOs are running away, more college students are hearing the truth about President Trump, conservatism, and the new populist resurgence within the Republican Party.

And there is winning for me, the guy who got arrested for Trumped up charges in Huntington Park on June 6th, 2017.

I attended my first court appearance on September 6---and guess what? My name was not on the criminal calendar at all!



I confronted the HP Chief of Police Cosme Lozano, aka Cosme the Clown:



As you see in the video, he wasn't really interested in talking to me.

This is why we call him Cosme the Clown!


I tried to get an answer from him a second time, and he just ran into the city council chamber's executive room:


Of course, I had received a "notice of correction" and the court date was changed to October 23.

I went to the court, and guess what AGAIN? My name was not on the calendar!

The lawlessness overwhelming the Huntington Park City Council has to be exposed.

I get arrested for doing nothing, and then the city council routinely hammers law-abiding citizens, then they ignore those who disrupt the meeting!

Of course the Huntington Park police department does not want to file the arrest paperwork with the DA's office!

Oh, and by the way ... I received aother notice of correction. The next court date is December 4th. Funny stuff!

Hilarious! Corrupt Sanctuary City Police Chief Runs from Trump Supporters--AGAIN!

Huntington Park is a de facto sanctuary city. They have appointed two illegal aliens to city commissions, and in spite of the growing crackdown on illegal aliens throughout Los Angeles County, the city council has doubled-down on their lawless stupidity. 

Did they really think that they would get away with dishonoring our country's immigration laws?



The only reason why the corrupt city council and police administrators have gotten away with it is that the President and his federal enforcement team have focused on violent criminal aliens and the backlog of immigration judicial cases held over from the Obama Administration.

The crack down is only going to get worse, of course, since Governor Brown has signed off on a little piece of paper which orders local and state law enforcement not to cooperate with ICE.

El Dorado County Sheriff will not comply.

Orange County Sheriff's Department will not comply, either, as they have continued their contract with ICE to house illegal aliens for deportation.

Different municipalities in Los Angeles County chose to defy the federal government and their own sheriff to pander to illegal aliens and their illegal enablers.

Shameful, but true.

At the same time, in Huntington Park, I was arrested for sitting in a meeting and saying nothing.

Crazy but true. I am now convinced that the Huntington Park police department delayed my arrest because they knew that they had overstepped their authority. They had neither right nor reason to arrest me for disrupting the meeting.

I didn't. I was quiet, while other members of the audience were routinely calling out or shouting at me, and the mayor did nothing about it.



Huntington Park police chief Cosme Lozano had me ruled out of order, then an agitator behind me lied to the public claimed that I had already been ruled out of order. I refused to leave since I had not disrupted the meeting, and it was crystal clear that the mayor and her police and activist cronies were just lying about me to get me thrown out of the meeting.

Now it gets really interesting.

I was taken down the Huntington Park jail. I was booked in, with all my personal affects taken from me. I waited in the holding area for about an hour.

Then I was fingerprinted and my headshot taken, then I rested in a jail cell for about an hour. 

Then I was released from the jail. No bail, no directions from a judge--nothing.

Two weeks later, I realized from another previous arrestee-who was eventually exonerated--that I did not receive a booking number or a wristband! Did they even put anything in place regarding my arrest? Did they file anything at all?

When I arrived in court on September 6th, 2017 at Downey Court House, my name was NOT listed on the calendar for any criminal court!



I had some interesting questions for the Chief of Police about this:



Instead of telling me what was going on, he said to me "No comment", then ran off to the Police Department Headquarters.

What?!

What kind of police chief is this? Someone who refuses to explain why he would have someone arrested, but take no time to file charges.

All of this is quite strange!

Then I confronted him a second time, and guess what?

He ran away!

I literally begged the police chief to file the paperwork with the District Attorney's office!



Have you ever heard of such crazy nonsense or incompetence?

Huntington Park City Council: Anti-American To the Core

To the Huntington Park City Council:



Today's secret word is 'filing'. This city council, through the corrupt police department filed false charges against me--failing to follow a lawful order from a police officer, and disrupting a meeting. I did neither.

I attended the prescribed court date, and guess what? The police department had not even filed the paperwork to the DA! What's the problem? I know that the police know how to file paperwork--after all, it was Alfred "Full Capacity" Martinez who had filed the UUT repeal initiative, along with Comse the Clown over here.


So, why didn't the HP Police Department file the paperwork? Most likely because you do nothave a case against me, although I certainly have a case against you. I was honored to see two other Huntington Park residents denounce the police in this city, too. I feel that my example has encouraged others to speak out against your corrupt anti-citizen hatred. See you in court, Cosme!

Now, returning to the reasons why we come here:

I wonder how much longer those two illegal aliens--Francisco Medina and Julian Zatarian--will remain on those comissions. Trump's pro-American enforcement agenda has continued apace:



1. Illegal border crossings are down 71%
2. The US Army is ending contracts with illegal enrollees
3. VISAs have been revoked for countries which refuse to take back their illegal natuionals
4. The Temporary Protective Status program will be phased out
5. The Democratic Party has completely fractured over the Nightmare Kids--the young illegals brought here by their selfish, unthinking illegal alien parents. President Obama and his party could have offered them full amnesty, but refused to--because they simply wanted to use those illegals as a bargaining chip for more power. Even they have figured out that you are lying to them.

Nancy Pelosi couldn't speak when the DACA Nightmares took over her press conference. I hope they keep up their temper tantrums, as you and your anti-American lawlessness simply bolster the argument that we have made from the beginning: national security and border integrity will be this country's main priority, and all illegal aliens must be deported.



President Trump is demonstrating true Acts of Love, putting Americans first and honoring the dead dreamers whose lives were cut short by illegal immigration. The needs of America's Dreamers will receive full and final attention.

For that reason, I am not surprised that many of your vocal supporters have harassed young children in this city. These Brown Supremacists seduced little kids to chant curse words and anti-Ameican hate. At the last meeting, they pointed at American Dreamer Sean Aldeguer and called him 'racist'.

This is child abuse, and abusers like Silvia Merlos, Jaguar Red Heifer, RG Wong, and Edin Enamorado have been exposed for the anti-American bigots that they are

2. Being a Trump supporter
3. Because they are racists who hate white Trump supporters?
4. The corrupt police chief doesn't like citizens who know their rights?

They claimed that I was disrupting the meeting, and that I failed to follow the lawful order of a police officer.
