BREAKING: Federal Judge Walks Back Pro-DACA Ruling

Here's some incredible news from last week which received very little press so far:


Yes, the same arrogant federal district judge who had arbitrarily demanded that President Trump and the Department of Homeland Security begin accepting DACA applications again, has backed off that demand.



The federal judge who had ordered the government to restart the Obama-era deportation amnesty in full has backed off his decision and said the government does not, after all, have to begin accepting brand new applications.

Judge John D. Bates acknowledged the legal mess that’s arisen around the program, called the Deferred Action for Childhood Arrivals (DACA), and said he didn’t want to make it worse, so he issued a partial stay of his own ruling.

How about that! The judge saw the light, or more likely he felt the heat, realizing that his capricious judgment would not only have been overruled, but perhaps would have embarrased him greatly in front of his judicial peers.

One thing that I have learned about judges, even the federal ones with lifetime tenure: they have to be overturned. They do not like developing a reputation in which their decisions are automatically doomed to failure and rejection. It just hurts their pride on so many levels, and these federal judges are full of pride.

That means that while “Dreamers” who already have had DACA protections can apply for renewals, no new applicants can seek to start the process.

So, the Trump Administration will not have to fight the foolish order which would have forced them to accept new applications. What a savings, but they still have to fight to ensure that current DACA recipients can no longer receive those permits.

And it gets better. This arrogant judge had to go back further on his own ruling!

Judge Bates also delayed part of his previous ruling that would have let those who can stay under DACA also apply for special protections known as advance parole — permission to travel outside the U.S. and then return — which can, in some cases, turn into a pathway to citizenship.

Wow!

This is incredible. These same recipients have no guarantees of safe re-entry once they leave the country. They should take a one-way ticket back to their countries of origin, along with the parents how uncharitably brought them into the United States against their--and more importantly our--will.

Hundreds of DACA recipients had exploited that loophole under the Obama administration, but the Trump administration had shut it down.

Thank God for President Trump! One rule of law, and full enforcement of the rule of law is needed in this country.

The government had said that if DACA were completely restarted more than 100,000 new applications would be filed, as well as 30,000 requests for advance parole. That would overwhelm U.S. Citizenship and Immigration Services, the agency that handles the applications, Judge Bates ruled.

This federal judge is coming up with an excuse which will make him look good while making the Trump Administration look bad. "I am the good guy," the Judge Bates wants to signal to the public, "but because the Trump Administration's citizenship processing facilities and staffing are inadequate, I am going to undo my order."



AS IF!

The truth is that this federal judge, like the series of federal district judges who have waged unjust lawfare against President Trump's proper executive authority, had no right to reinstate an unconstitutional program, one which did not originate in Congress, nor did the program derive from any just powers assigned to the President by Congress.

DACA is a terrible fraud, a blight on modern United States legislative prudence, and something which President Trump had every right to rescind. The President engaged in an incredible series of media, policy, and political maneuvers to get what he wanted--enforcement of our laws--while taking advantage of the media to make himself appear reasonable and compromising on this issue.

The Democrats refused every single offer for amnesty, because President Trump would have received even more essential reforms, like ending chain migration, terminating the dangerous diversity visa lottery, and transferring all necessary funds to building the border wall.



He said he realized immigrants who were in the U.S. illegally were being denied rights he said they were entitled to, but said he feared the confusion that would result.

The confusion has already resulted, your DIS-honor, because of President Obama's lawlessness. President Trump and his staff are doing the right thing to demand full enforcement of our immigration laws and the deportation of all illegal aliens out of our country. He is trying to bring stability to this very confusing, chaotic situation, and you would have made it much worse.

For anyone reading this account, this judge's decision to roll back his own ruling is nothing short of incredible.

“Because that confusion would only be magnified if the court’s order regarding initial DACA applications were to take effect now and later be reversed on appeal, the court will grant a limited stay of its order and preserve the status quo pending appeal, as plaintiffs themselves suggest,” he said in a short opinion late Friday.

Immigrant-rights advocates, who had originally wanted a full restart, eventually changed their minds and agreed with the split ruling of no new DACA applications, but renewals could be processed.

Here's the problem. Even with all of these half-baked rulings, the injunction against DACA applications will continue. Other federal district courts, with real judges who interpret the law and respect the power of the executive, will continue to challenge this terrible program.

That decision was based on a legal gamble.

DACA cases are pending in three courts right now. Judge Bates‘ case is likely to be appealed to the circuit court in Washington, D.C., while circuit courts are already handling appeals of similar decisions from California and New York.'

The idea is that the appellate courts in these liberal jurisdictions will affirm the lawlessness. What the don't understand, however, is that Trump has continued to reshape the judiciary to respect the United States Constitution rather than progressive ideals.

Each of those lawsuits challenged the Trump administration’s decision last year to phase out DACA. The judges in those cases ruled that the Trump administration cut too many corners, and so the phaseout is illegal.

But another case in Texas involves a challenge to the original 2012 Obama administration decision to create DACA in the first place. If that judge were to rule against DACA it would create a messy situation where the program itself is illegal — but so is the phaseout.

The program is illegal. The program is unconstitutional. DACA must go. No judge has a right to protect any order like this, and the President had every right, every necessity to end this terrible, unlawfull program. Seriously, what is going through some of the federal judges' minds? Did they not graduate from law school? Do they have any legal training whatsoever, or are they a bunch of recently-installed SJWs who came into the legal profession to change the world to their perverted, idealized liking?

The activists in the case before Judge Bates figured that they could undercut the anti-DACA Texas case by agreeing not to allow new DACA permits to be granted.

Final Reflection

One federal judge had to stay his own ruling. That almost never happens. In fact, to the best of my knowledge, that has never happened. The idea that these overly powerful judges would realize that they went too far, well that seems so far-fetched as to be unreal.



Yet here we are. This is great news for the rule of law and for the widespread citizenry who tired of the pandering and placating which has been done for illegal aliens, while the expected protections of the rule of law for citizens continue to be ignored.

The DACA program is facing legal challenges from every angle, and more conservative jurists at every level of the federal judiciary are bringing back constitutional governance again. This program is going to die a slow, lingering death, and DACA recipients are going to realize that there is less and less chance of their receiving any kind of amnesty, especially after the 2018 election, in which there is a strong likelihood of more Republicans in the United States Senate, and some reports indicating that the House will stay remain in Republican hands, albeit by a slimmer margin.

DACA is over, and even the federal activist judges realize that they cannot fix it.

This is YUGE VICTORY for our side!


How about we focus on putting American Dreamers first for a change, while we are at it?

ACLU: Anti-Christian Lunatic Union Attacks American Sovereignty

The American Civil Liberties Union needs to be sued in turn.

Shame on these people. They promote anti-American hatred, all while claiming to be a signature, pro-American platform. What a bunch of bigoted frauds.

We need to stand up to this immoral corruption. American exceptionalism is not something to apologize for, but something to celebrate.

It's time that we get into action and push back!

WINNING! Illegals No Longer Applying for In-State Financial Aid

Wow, the news keeps getting better and better.

President Trump's clear and convincing rhetoric is working wonders on the illegal alien problem here in the state of California. All the sanctuary state talk in the world is a big dud when it comes to actual enforcement and follow-through.



The fact is that illegals are in the country ... illegally. It makes no difference how they got here. What matters is that their parents broke the law (if they came as children), or they broke the law themselves by breaking into this country on their own.

Enough is enough. This country's compassion has been pushed to the limit. It's not fair that we are treated with such disdain as American citizens, and we have illegal alien activists demanding full citizenship and all the entitlements they claim that go with it.

Here is the report from KQED indicating that illegal aliens are no longer taking taxpayer dollars for in-state tuition grants from young citizens:



Today is the deadline to apply for California’s major financial aid programs, and officials have been scrambling for weeks to assure undocumented students it’s safe to do so.

The deadline has passed.

It's over. American students must come first, not illegal aliens.

Undocumented students can’t get federal financial aid, but the California Dream Act opened the door to state financial aid starting in 2012-2013. Since then, application numbers had gone up every year — until this one.

Illegal aliens should not be getting any kinds of benefits or incentives from taxpayer coffers. That is wrong. Illegal aliens need to go back to their home countries. Any kind of DREAM Act must go toward American citizens, young Americans who are struggling to find work and make life great again for themselves and their future.

Stop the invasion. No more illegal immigration!

The California Student Aid Commission began to see a chilling effect from harsh immigration rhetoric last year, when the annual increase in applicants they’d come to expect slowed.

Enforcing immigration laws is not "harsh", it's a lawful response and outcome. I want our immigration laws enforced. That is not a "hardline" stance.

This year, fears have been amplified as rhetoric gives way to high-profile enforcement action. California officials say students’ personal information is safe with them, but it’s a tough sell.

Our President is actually doing stuff. That's what the voters wanted, and he is making America great again.

In mid-February application numbers were down by nearly half compared to last year, but a major campaign to get the word out has had some impact. That gap has narrowed significantly — now the numbers are down less than 10 percent and counting. Still, the commission is bracing for a decrease in applicants for the first time since the program began.



It should be shut down entirely, not just decreased.

“Every hour I grow more and more concerned,” said California Student Aid Commission director Lupita Cortez Alcala. “We’ve done everything that we can possibly think to do.”

How about you start caring about Americans? 

She said they’ve held press conferences, phone banks and information sessions across the state. They even got a celebrity DJ involved.



The celebrity needs to be arrested.

San Francisco City College student Alejandro Villeda did apply for aid, despite some reservations, and he encouraged his classmates to take advantage of this opportunity.

“I feel like the best (way) to make our voices loud is to have an education,” he told the crowd at a news conference earlier this week.

At taxpayers' expense. That is wrong, and we are not going to tolerate this anymore. Enough with these illegal aliens. We need to put American Dreamers first, foremost, and final. That's it.

But privately he said many of his friends had made a different calculation and chose not to apply, for fear immigration agents would get hold of their personal details. “They worry somehow that information gets shared and they’re gonna go look for them because they know exactly where they live,” he said.

We will make sure that ICE learns the location of all illegals in the state of California. ICE raids are going to continue apace, with or without California's support.

Alejandro Jimenez, director of City College of San Francisco’s resource center for immigrant students, said he understands those fears, but encouraged students to think about what’s at stake.



The illegal aliens should be scared. They broke the law, they broke into this country, and California residents are sick and tired of being broke!

“Having the California Dream Act is the difference between having to have two or three jobs and taking one class at a time, or moving along in your education,” he said. “Please take advantage of this deadline.”

Shame on these people! This white-guilt, white supremacy garbage must be confronted once for all.

Shame on all of them. I want to see the end of all this illegal alien pandering, and I want California institutions to respect the needs of American students.

Illegal Alien Massacres and Dead Americans--What About Their Dreams?

The press goes nuts over mass gun shootings.

They are horrific, and they are preventable. If state legislatures stopped punishing law-abiding citizens and started going after lawless criminals, our lives would be more secure.

The FBI spent more time going after hoaxes of Trump-Russia collusion, when they should have heeded the repeated warnings about Nikolas Cruz.

There are other preventable crimes taking away our loved in other cases, too:
Kate Steinle had dreams.



So did Ruben Morfin, Dominick Durden, Drew Rosenberg, and thousands of others.

These are unnecessary tragedies.

What about Ronald De Silva, the son of Agnes Gibboney? He was an accidental target in a gang-bang drive-by. Where were his dreams? Why did he have to be gunned down by an illegal alien thug?

These are the stories we need to be talking about, as well as the victims of mentally deranged fanatics with firearms.

Getting tough on MS-13 
Elizabeth Alvarado, Robert Mickens, Evelyn Rodriguez, and Freddy Cuevas joined President Donald J. Trump last week as four of the special guests for his first State of the Union Address. They are the parents of Nisa Mickens and Kayla Cuevas, two young girls who were killed by the gang MS-13 in September 2016.
It’s estimated that MS-13 has as many as 10,000 members in at least 40 states. In the immigration framework President Trump sent to Congress last month, the White House calls for a bill that will give law enforcement the tools it needs to combat this brutal gang and stop its proliferation into American communities.
Today, the President is hosting a roundtable with law enforcement professionals and community leaders to discuss what immigration reforms are needed to dismantle this transnational gang once and for all.

Vice President Pence’s message in South Korea 
Vice President Mike Pence left yesterday en route to Asia, where he’ll lead the American Presidential Delegation at the 2018 Olympic Winter Games in South Korea. Second Lady Karen Pence joined him as a member of the Delegation.
This year’s Games hold particular importance given the recent actions of North Korea related to its nuclear weapons program. President Trump held a call Friday with South Korean President Moon Jae-in before meeting with defectors from North Korea in the Oval Office.
It was announced over the weekend that a special guest will accompany Vice President Pence. “Honored that Fred Warmbier, father of Otto Warmbier, will join us” in South Korea, the Vice President tweeted. Otto Warmbier was an American student detained in North Korea for 17 months before being released in severe condition and passing away four days later.

‘Four magnificent words’ 
President Trump addressed workers at an Ohio manufacturing company yesterday, talking through the effects of tax reform and previewing what the Administration will fight for in 2018.
"Right here in Cincinnati, the Sheffer Corporation announced every single worker was getting a $1,000 tax cut bonus,” the President said. “That’s good. Hard working patriotic Americans like you are what makes this country run.”
At heart, tax relief is about reinvigorating the great middle class that built America. “We’re bringing back those four magnificent words: ‘Made in the USA,’” the President said.

Senator Dianne Feinstein Responds: Still Stands with Illegals, Ignores American Dreamers


Dear Mr. Schaper:

Thank you for writing to express your opposition to the “Dream Act of 2017.”  I appreciate the time you took to write, and I welcome the opportunity to respond.

On July 20, 2017, Senator Lindsey Graham (R-SC) and Senator Dick Durbin (D-IL) introduced the “Dream Act of 2017” (S. 1615).  This legislation would provide a path to legal status to undocumented persons who were 18 years or younger when they first arrived in the United States, have lived in the country four years prior to enactment, and have satisfied certain higher education or military service requirements, among other criteria.  This bill is currently pending before the Senate Committee on the Judiciary, of which I am Ranking Member.




I believe there is a need to protect undocumented young people, known as “Dreamers” from deportation.  These young people are fiercely patriotic, and are American in every way that matters.  The typical recipient came to this country at 6 years old. They’ve known no other home, but this one.  Many of them only speak English.  I believe that protecting these youngsters isn’t a matter of politics or economics.  It’s really about what’s right as Americans and human beings.  I really believe we have a moral obligation to do all we can to shield these young people from deportation.  For this reason, I have long supported giving certain foreign-born children, known as “Dreamers,” the opportunity to apply for legal permanent residence if they attend college or serve in our military, pass security checks, and meet other criteria.

While we may not agree on this particular issue, please know that I respect your opinion, and I will be mindful of your views as Congress considers reforms to our nation’s immigration laws. 

As Ranking Member of the Senate Judiciary Committee, which oversees our nation’s immigration laws, your thoughts are important to me.  Please know that I will keep your concerns in mind should immigration legislation come before me for consideration.

Trump Supporter States Tough Love on DACA, Amnesty

                      

Wes Parker was one of six featured members of a focus group on Jimmy Kimmel's show Tuesday Night.

Here, he outlines why it's important for American citizens to stand their ground and assert the sovereignty and safety of the United States of America against illegal immigration, even the DACA recipients, who should have never received it in the first place.

The people who break into this country do not love the United States. They love the money that comes from a free society based on limited government and constitutional rule. However, illegals are welcoming the same crime and corruption which they were fleeing in their home countries.

Tweet to the 34 Pro-DACA GOP House Reps: No DACA, No Amnesty, Put Americans First!

We the People have won the first round against the pro-illegal alien activists, Big Business, and the Open Borders Lobby in Congress. As much as they tried, they could not induce Democrats to force a government shut-down to get a DREAM Act amendment onto the Continuing Resolution package passed at the end of December 2017.



The fight is real, however, and the DACA demands have not abated. Amnesty is still lingering in the halls of Congress, and unless our representatives hear loudly and clearly from American citizens, they will go along with the guilt-tripping media, along with the pressures and demands of Big Business, Big Labor, and Big La Raza.

We need to double down on every single pro-DACA Republican in the House of Representatives to make sure that there are no DACA deals, no DACA "fix", no amnesty of any kind. The federal government has a responsibility to protect the life and liberty of American citizens, not illegal aliens.



Here are some crucial facts to share with office staffers and fellow citizens:

Some reports have suggested that as many as 50% of the DACA recipients received those permits through fraudulent or distorted means. Many of these young illegals are not really young, but their average age is in the mid-20s. Any talk about ending chain migration as part of any DACA deal will not work, since illegals granted legal status can start filing lawsuits or upon receiving full naturalization, can start sponsoring their family members, both immediate and extended, along with distant relatives. The demands for more amnesty will never stop.

Remember the looming tide of young illegals who crowded the southern border of the United States in 2014? All of these illegals were inspired to rush the border because elected officials in Washington DC and advertisements throughout Latin America were informing these "youth" (since many of them happen to be adults, in fact).



The cost to incorporate, integrate, and provide for 800,000 illegals is toward the tens of billions alone. The long-term cost to our country's health, well-being, quality of life, public safety is too great to allow any more amnesties. At this point, American leaders and lawmakers need to put Americans First.

Justice: OC Register Promotes Life Stolen by Illegal Aliens, Exposes Violent Indivisibles

December 19th, 2017 We the People Rising went to Congresswoman Mimi Walters' office to demand that she retract support for illegal aliens and oppose any kind of DACA "Fix". The unconstitutional program and all permits issued under it should be rescinded and sunset without further legislative action.

The illegal aliens who had prospered under that program should have never entered the country in the first place. They have gotten a great deal of good in this country in spite of the dubious status of that order. It's time for illegal aliens and their children to return to their home countries and enter the United States the legal way. We already have a pathway to citizenship in our United States Code. Everyone who wants to immigrate to this country must do so legally.

Mimi Walters has faced unprecedented pressure and outrage from the Indivisible 45 Group. They have gone after her in different sections of her district, which stretches from Irvine to Laguna Beach. According to the Irvine Detective supervising protester safety in front of her Irvine office, a number of them have been arrested for disturbances and violence outside of her office.

Incredible.

The woman above was completely unhinged in front of me. She grabbed my camera as I was interviewing her and demonstrating on behalf of young Americans killed by illegal aliens. The two police officers had to force her back, and as she retreated I shouted at her that she should be ashamed of herself for attacking me.

In this video, she goes absolutely nuts, and then I call out after her for attacking me.



Of course, she ran away as other members of the Indivisble 45 protesters gathered around her and held her hands. Then she started crying, and I called her out on that, too. Liberals and leftists have been telling themselves and others that they are perennial, eternal victims, and that mentality leads to acts of violence, like that woman grabbing at my camera.

Shame on her. Shame on all of them!

Not only did I catch them showing their true colors, but the OC Register photographer gave much-needed coverage to the Americans killed by illegal aliens.

Once again, I am really, really impressed that the OC Register photographer respected my wishes and covered me with fair and balanced respect. The LA Times reporter and photographer was present, too, and he just asked me my name, nothing more.

The Los Angeles Times sent one reporter to do a series of hit pieces on me, and they have pretty much fallen flat. The OC Register has provided more quality reporting, I have found.

In spite of the fact that I could not meet with Rep. Mimi Walters' staff about ending DACA and stopping amnesty, I am really glad that I could be there.

Arthur Schaper Defends American Dreamers Killed By Illegals at Pomona City Council Meeting

                      

I am so proud, so honored that I could speak up on behalf of American citizens killed by illegal aliens.

The "DREAMer" card has been the last-ditch, desperate effort of pro-illegal forces and the illegal aliens themselves. They have sought to induce a sense of shame and force on American citizens, as though we should feel compelled to care for the young illegal aliens brought into this country by their law-breaking parents.

That is wrong, and we cannot allow this amnesty-shaming to work on us any longer. We are not responsible for the children of those adults convicted of crimes. No taxpaying, law-abiding citizen should feel guilty or feel pressed to provide resource or recourse for those young illegals, who are now actually adults. Up to 50% of DACA recipients have received these unconstitutional permits based on lies and fraud.



In my one-minute speech, I reminded the audience about the average of 25 Americans killed by illegal aliens every day. I talked about the millions of Americans pushed out of work because of the rapid influx of cheap labor into the country. I also talked about how the DREAMers can still have their dreams across the border or the seas ... in their own countries. Ruben Morfin, Marcello Bisarello, and other dead Americans can no longer have dreams because they are dead.

LULAC in Full Panic! No DACA Amnesty in Budget Bill

LULAC is going crazy, again!

The DREAMers are getting deported, and there is nothing that the liberal or Republican establishment can do about it!

Their latest eblast is all huff and puff.

It's over, folks. We the People of the United States will be the final arbiters of who lives and does not live in our country.


It’s been three months since President Trump ended the DACA program and shifted responsibility to Congress to enact DREAMer protections by March 5, 2018. After that date, over 800,000 young immigrant DREAMers will be targets for deportation as their DACA permits begin to expire.



We can’t let that happen.

This week, LULAC members from across the country will gather with other organizations in Washington, D.C. to demand that Congress protect DREAMers and pass the Dream Act of 2017. Here's how you can get involved:
