Kevin Kiley: Making California Newsom Proof

Kamala Harris is reportedly considering running for California Governor in 2026. If she does, the governorship will be seriously in play for Republicans. In fact, the last time Kamala sought a statewide office she came within one percent of losing.

Newsom, for his part, was just in DC. He held a lightly attended lunch with House Democrats and vowed to “Trump-proof” California. The main reaction was eye-rolling. As I said on Inside California Politics, the reality is California voters have started to Newsom-proof our state.

While Newsom was supposedly here to advocate for California, he only met with Democrats. When asked why he didn't meet with Republicans – the Majority Party – he said because he's "married to one." (Fact check: he's not.)

Meanwhile, there are still nearly a million votes to count in California. Everyone in DC is asking me why, and there is no good answer. At best, it is sheer incompetence from a broken state government. In this way, it offers the rest of the country a window into Newsom’s failures.

I’ve told them: If you think California is good at counting votes, just wait until you see how great our state is at building roads, storing water, running DMVs, and processing unemployment claims. And you’ll definitely want to take a ride on our state-of-the-art High Speed Rail.

Despite the vote-counting insanity, it was a great election for California. Republicans are close to flipping an Assembly district Biden won by 19 percent. This is in addition to the 5 million vote landslide for Prop. 36, the ouster of lawless DAs, and the strong rebound in GOP registration.

The shift in voter sentiment is unmistakable. And to top it all off, a court just threw out Newsom’s attempt to stop Huntington Beach from requiring voter ID. Another win for the Coalition for Common Sense.

Will Initiatives Save California?

Kevin Kiley's latest post shames Newsom for yet another failure in the federal courts, this time dealing with AB 32, which all but shut down ICE detention centers. The supremacy clause pushed back on this abuse of power, according to the Ninth Circuit Court of Appeals.

Big Victory.

And there's more.

A number of initiatives are going through for people to collect the signatures to place the efforts on the ballot. Do you think they are worth the effort? Even if they pass, will there be political will and willingness to enforce the ballot measures?

Another California law has been ruled unconstitutional. With AB 32, Newsom and the Legislature tried to force ICE to close its detention facilities. Today the 9th Circuit held this violates the Supremacy Clause.

Next year, Newsom and the legislators who passed this law will face voters. Perhaps more importantly, several transformative initiatives will be on the ballot. 

The full list of initiatives soon gathering signatures for the 2022 election includes:

• School Choice. Let funding follow the child 
• Water Storage. End the era of shorter showers
• Death Tax Repeal. Restore a protection of Prop. 13
• Election Integrity. Require voter ID
• Taxpayer Protection. Require voter approval for tax increases
• Anti-Corruption. End government union collective bargaining
• Accurate Ballots. Assure accurate descriptions of Propositions

Our movement is creating a new landscape of political possibility, and the fight for California’s future has only just begun.

Asm. Kevin Kiley Announces Exploratory Committee for Governor

I want to thank everyone who has encouraged me to run in the Recall election. I can’t tell you how humbled and appreciative I am.

I got involved with the Recall in a supporting role: to help support the countless Californians who worked tirelessly, heroically, to build the greatest citizens movement in our history. I didn’t do so with any intention of being a candidate.

As I’ve traveled the state, I’ve had the chance to meet many of you in person. I’ve listened to your input, and have learned so much. I’ve thought about what it will take to get our movement across the finish line. And I’m ready to play whatever role gives us the greatest chance to make that happen.

To that end, Orrin Heatlie, the Lead Proponent of the Recall, has offered to organize a committee of Recall leaders to explore that question: whether my candidacy would best serve the goals of removing Newsom and bringing the fundamental change California needs.

At this point, much about the race remains unsettled. That includes the election date, which is looking like September but could be November. The field is also still taking shape. For instance, former acting Director of National Intelligence Ric Grenell is still considering a bid, and he’d be an immediate frontrunner.

So before taking any formal steps, I’m going to trust in the citizens who built this movement. Orrin’s group will account for all dynamics in advising on the best path forward. And I’d love to hear from you directly – just reply to this email!

Running for Governor is never something undertaken lightly, and that’s especially true at this moment. Any candidate must approach the task with the greatest measure of humility and the highest sense of responsibility.

But also, with a sense of possibility: an earnest excitement for what we can achieve together, as we endeavor not just to fire America’s worst governor but to save America’s greatest state.

We’ve already made history. Now comes the fight for California’s future.

Assemblyman Kevin Kiley: "Hold it on Eric Holder"

I think hell has frozen over.

There are lawmakers in Sacramento who are not afraid to make noise and denounce the Democratic supermajority in the state legislature. I was worried.

But I have new hope.

Assemblyman Kevin Kiley is outspoken, and is speaking against the hire of former, disgraced, contemptible Eric Holder as an addition counsel for the state of California.

Assembly member Kevin Kiley has requested a formal ruling from state lawyers on whether the decision by Democratic legislative leaders to hire Holder and his firm, Covington & Burling, for $25,000 a month violated a provision in the state's constitution that bans hiring outside counsel for work the state's own lawyers can do.

When's the last time that an elected official challenged the actions of the rogue Democratic majority and so soon in the legislative session? This is incredible.

$25,000 a month is a lot of money, and to waste it on a former US Attorney General who was found in contempt of Congress--that's just unconscionable.

Holder is in contempt of Congress--still.

This man was running guns to Mexico, one of which killed an American deputy.

"People might have differing feelings about Eric Holder and about the incoming presidential administration, but all of us should be able to agree that as legislators we have a duty to abide by the law," Kiley, an attorney, said in a phone interview on Monday.

Kiley is the first person I can think of in the last two months to raise the "rule of law" issue.

The rampant lawlessness of the Obama administration now connects directly with the California state legislature.

The Sacramento politicians need to have their funding pulled and their liberty taken away.

How much longer do they really believe that they can get away with ignoring the federal government? Obama is thankfully leaving office, and with his departure we will have law and order once again in the United States.

Here are more reasons to be unhappy so far.

 California Republicans have been mostly quiet on Democratic Governor Jerry Brown's nomination of Becerra. But the hiring of Holder, who was Obama's attorney general from 2009 to 2015, prompted an outpouring of protest from Republican lawmakers.

Republican legislators need to stop saying nothing, and start shouting at the top of their lungs. I cannot believe the unjust silence of our representatives. They took an oath of office to uphold and defend the Constitution, did they not?

They are already violating their oath, swearing that they will ignore the Trump Administration and protect illegal aliens. All of this is wrong.

Kevin Liao, a spokesman for Democratic state Assembly Speaker Anthony Rendon said on Monday his office had conferred with the state Legislative Counsel and other legal sources before hiring Holder's firm.

Which ones? Covington and Burling, perhaps?

He disagreed the hiring was prohibited, saying the constitutional ban referred to hiring by the executive branch of government and not the legislature.

Liao added that legislature needed legal advice from attorneys experienced in dealing with federal agencies and federal law - cases in which the state attorney general's office does not specialize.

Then why is Governor Brown and the Democratic caucuses choosing Javier Becerra in the first place?
