President James Madison Rejects Infrastructure Bill (March 3, 1817)


 

To the House of Representatives of the United States:

Having considered the bill this day presented to me entitled "An act to set apart and pledge certain funds for internal improvements," and which sets apart and pledges funds "for constructing roads and canals, and improving the navigation of water courses, in order to facilitate, promote, and give security to internal commerce among the several States, and to render more easy and less expensive the means and provisions for the common defense," I am constrained by the insuperable difficulty I feel in reconciling the bill with the Constitution of the United States to return it with that objection to the House of Representatives, in which it originated.

The legislative powers vested in Congress are specified and enumerated in the eighth section of the first article of the Constitution, and it does not appear that the power proposed to be exercised by the bill is among the enumerated powers, or that it falls by any just interpretation within the power to make laws necessary and proper for carrying into execution those or other powers vested by the Constitution in the Government of the United States.

"The power to regulate commerce among the several States" can not include a power to construct roads and canals, and to improve the navigation of water courses in order to facilitate, promote, and secure such a commerce without a latitude of construction departing from the ordinary import of the terms strengthened by the known inconveniences which doubtless led to the grant of this remedial power to Congress.

To refer the power in question to the clause "to provide for the common defense and general welfare" would be contrary to the established and consistent rules of interpretation, as rendering the special and careful enumeration of powers which follow the clause nugatory and improper. Such a view of the Constitution would have the effect of giving to Congress a general power of legislation instead of the defined and limited one hitherto understood to belong to them, the terms "common defense and general welfare" embracing every object and act within the purview of a legislative trust. It would have the effect of subjecting both the Constitution and laws of the several States in all cases not specifically exempted to be superseded by laws of Congress, it being expressly declared "that the Constitution of the United States and laws made in pursuance thereof shall be the supreme law of the land, and the judges of every State shall be bound thereby, anything in the constitution or laws of any State to the contrary notwithstanding." Such a view of the Constitution, finally, would have the effect of excluding the judicial authority of the United States from its participation in guarding the boundary between the legislative powers of the General and the State Governments, inasmuch as questions relating to the general welfare, being questions of policy and expediency, are unsusceptible of judicial cognizance and decision.

A restriction of the power "to provide for the common defense and general welfare" to cases which are to be provided for by the expenditure of money would still leave within the legislative power of Congress all the great and most important measures of Government, money being the ordinary and necessary means of carrying them into execution.

If a general power to construct roads and canals, and to improve the navigation of water courses, with the train of powers incident thereto, be not possessed by Congress, the assent of the States in the mode provided in the bill can not confer the power. The only cases in which the consent and cession of particular States can extend the power of Congress are those specified and provided for in the Constitution.

I am not unaware of the great importance of roads and canals and the improved navigation of water courses, and that a power in the National Legislature to provide for them might be exercised with signal advantage to the general prosperity. But seeing that such a power is not expressly given by the Constitution, and believing that it can not be deduced from any part of it without an inadmissible latitude of construction and a reliance on insufficient precedents; believing also that the permanent success of the Constitution depends on a definite partition of powers between the General and the State Governments, and that no adequate landmarks would be left by the constructive extension of the powers of Congress as proposed in the bill, I have no option but to withhold my signature from it, and to cherishing the hope that its beneficial objects may be attained by a resort for the necessary powers to the same wisdom and virtue in the nation which established the Constitution in its actual form and providently marked out in the instrument itself a safe and practicable mode of improving it as experience might suggest.

CA Republicans Voted to Eliminate R-1 Zoning, Too (And the Root Failure of Representation)

I have been telling people for the last few weeks that we do not have representative government at all in Sacramento, and not just because Democrats have a raging supermajority.


I submit that even if everyone was a Republican legislators in Sacramento, there would still be lots of bad legislation passed and forced onto the state.

The third-house money that runs Sacramento, the lobbyists and special interests, have an unrelenting chokehold on everything that happens in the state capitol.

Don't believe me?

Consider the sudden passage of SB 9 and SB 10, two pieces of legislation which all but eliminate single-family zoning limitations in local and county governments. As of this week, developers can now buy up single-family lots and put four homes on a lot that was zoned for only one home. This increase in potential housing stock will not bring down prices. In fact, since most of the developments are coming to high demand locations, it will just create more high-cost housing. And don't forget that more residents in high density areas just means more demand for fewer resources.

Republicans as well as Democrats voted for these assaults on local control.

The bill passed the state assembly by only 45 votes! If every Republican had stood their ground and voted NO, the bill would have failed!

This is the second time that the Republican caucus in the State Assembly helped screw over voters. Seven Republicans! UNBELIEVABLE!

Seven state assembly Republicans voted to strip away local control from cities. Hell, even my corrupt, pro-pedo Democrat assemblyman Al Muratsuchi voted against both of these terrible bills! More libtard Democrat voted to protect local control than Republicans.

What's going on here? Real estate and developer money is flowing freely into Democratic and Republican coffers. Same holds true for unions, both private and public sector. The passage of Jungle Top Two primaries gave these third-party interests more power than the political parties, as well. 

Let's face it: Political parties do not run Sacramento, and neither do voters. It's really sad, but this is where we are now. The special interests, the big time donors, the major corporations, they run this state. California is an aristocracy of special interests, not the public good.

The fact is that a state assembly district has over 400,000 residents. Can anyone really say that they are represented by ANYONE in Sacramento?

Today, a state senate district contains about 1 million residents! That is larger than the representation for a Congressional district! There is no way that any one voter can feel that their voice matters in Sacramento with such overwhelming numbers crowding into each district. No one is really represented in Sacramento anymore. Third-House money and special interests have all the power now. They can amass the money, they can blanket a district for their chosen candidate. and most voters will go along with whatever is fed to them because the advocates for everyday citizens do not have that kind of money to fight back.



This disparity in representation explains everything. There is no way that a common community of citizens can really band together and fight back against bad legislation as this point. The special interests call all the shots. Real estate agents and developers want lots of high density housing so they can make lots of money.

Labor unions want big contracts. The public sector unions run everything in Sacramento, too. It is so bad, and so blatantly, that when I confronted State Senator Ben Allen about making some form of school choice available, he told me plainly "The teachers union has to approve it."

They call the shots. They get to decide what passes and what does not pass in the state legislature. This whole corrupt process reveals fully how bad things have gotten in Sacramento and in the state of California as a whole, and why so many people are now just pulling up stakes and leaving the state entirely.

Pastor Art Pawlowski Defends Freedom of Religion and Conscience in the Alberta Court of Justice

Pastor Art Pawlowski gave the following speech in the Alberta Courts of Justice: 

I am here, before this court as a political prisoner of conscience!

The AHS and the politicians have found a new way of penalizing anyone that is opposing their unconstitutional medical Tyranny!

They hate the idea, that they have been exposed for what they really are. Liars, hypocrites and cheaters!

I have seen this growing back behind the Iron Curtain under the boots of the Soviets! I have heard from my grandparents about the similar tactics during the time of the Nazis! Persecuting Churches and the clergy! And that what we are talking here about. Canada has fallen very low!



Nelson Mandela said that when a man is denied the right to live the life he believes in, he has no choice but to become an outlaw.

The politicians and the AHS have been embarrassed by the level of hypocrisy and double standards that we have shown to the whole world and now they are using this court and this judge as their personalized weapon against us the whistleblowers that are simply exposing their corruption.

We do not have flu crisis; we have opioid crisis in Canada! Alcoholism crisis! Record high among the youth suicide crisis! Homelessness crisis! Hopelessness crisis! As a Pastor I do not just deal with the physical problems but also emotional, spiritual and mental as well! People in our community are dealing with loneliness, stress, grief, loss, and isolation and they desperately need their Pastors!

We are and always have been the front-line workers in the time of crisis! Now we are needed more then ever!

People need more Church not less! More prayers not less! We, the clergy are essential! Now, the Church is more essential than the corrupted politicians are!

How can the politicians say that they care about the health and safety of people if they are imposing rules and are not even bothering to follow them? If they claim these rules are about safety but they violate their own mandates, then it must NOT be about safety - so then what exactly ARE these mandates are about?

The politicians who mandated these orders, like masks, social distancing, lock downs have been caught breaking their own restrictions and should also be found in contempt and held accountable. And because they are not being held to the same standards, it shows to me that this is not about justice and the Rule of Law but about simple Vengeance.

If this was really about health would those politicians not keep their own mandates? If this was real emergency, would they be partying at the sky palace? If this so-called pandemic was real are those politicians not putting the public at large and their own colleagues at risk by breaking their own rules?

I am here in this court as a victim of a personal vendetta from a very corrupted and evil, lying and deceiving politicians! If I am guilty of a crime, then so it is the Premier of Alberta Jason Kenney with a bottle of Jameson Irish whiskey on the patio of the Sky Palace. Breaking their own rules and mandates with Parks Minister and House Leader Jason Nixon. And with the biggest hypocrite of them all, the boss of the AHS that is persecuting us here today, the Health Minister Tyler Shandro not caring about his own rules having good time with the Finance Minister Travis Toews (Tiws)! They also have broken the Rooks order! The Associate Chief Justice John Rooke order caught them as well! If I am guilty so, are they!

If this court has found us guilty and wants to send us to prison and is refusing at the same time to prosecute those that have subjected us to those mandates and broke them without blinking an eye then this court is willing to have two sets of laws, one for the corrupted politicians and one for the rest of us! Then this court is also not about justice and the Rule of Law!

I hope that this court is about justice and the Rule of Law not like those hypocritical politicians with their personal vendetta! If that is the case, then there is in fact selective and unjust application of the law and now two sets of laws, one for the corrupted politicians and one for the rest of us, citizens. If that is what would happen, then this would be the biggest mockery of the justice system in the modern history of democracy!

What is the government doing for the people that are looking for spiritual guidance? For those millions hurting, hopeless all around us? Do their lives matter? What safety measures are they taking for those people? What are they doing to stop the deaths from drugs and suicides?

Abraham Lincoln said those powerful words: Those who deny freedom to others deserve it not for themselves. If you sentence me you will be sentencing yourselves and those hypocrites in Edmonton in the Legislator!

Sure, you can lock us up and throw the key away, but our political imprisonment will shout even louder from prison about this hypocrisy and the mockery of justice! This will be loud and clear that this nation, Canada is no better then China, North Korea and Russia! The world will see that here in Canada there are two sets of rules! One for the corrupted politicians and another for the citizens!

If you send us to prison, you must send those Alberta politicians to prison also! We can even share a cell if that what you wish! However, if you will not do that then the whole world will know that there is no justice in Canada anymore!

John F. Kennedy said those powerful words: The rights of every man are diminished when the rights of one man are threatened.

The corrupted bureaucrats want my apology! They want me to say that I am sorry for doing my job! For saving lives! For feeding thousands of most vulnerable in our society! For giving hope to the people! Well, here is my answer: Exactly 500 years ago another man faced a very similar trial, and I was told to apologize, if he will recount he will be off the hook. His name was Martin Luther! Let me echo today his words as my response to those that seek to hurt me, to hurt the poor, our Church community and to hurt my family!

I opened the Church for the hurting people looking for help! For that I will not apologize!

I cannot and will not Recant anything, for to go against conscience is neither right nor safe. Here I stand, I can do no other, so help me God. Amen.

Canada 2021 Election Aftermath: "Conservatives" Lurched Left and Lost

Dear Arthur,

Although some mail-in ballots are still being counted and a few races are still in contention, it appears that the new parliament will look almost exactly like the old parliament.

The Liberals will gain three seats, moving from 156 to 159, while the Conservatives will lose two seats, dropping from 121 to 119. The table below compares the seats from 2021 with 2019’s election.

It can be argued that Justin Trudeau came out of this election with a damaged reputation because the public understands he called an unnecessary election - and wasted $600 million on it - for no other reason than to capitalize on polls which suggested that in a snap election, he’d win a majority. Which he failed to do.

However, Erin O’Toole is the leader who suffered the greatest damage, by far.

He blundered away what I believe should have been an easy victory that would have resulted in up to 156 Conservative seats compared to just 130 for the Liberals.

Down below, I’ll provide the math to back up that claim, and demonstrate that O’Toole helped Trudeau win by driving enough of his base into the waiting arms of Maxime Bernier, while demotivating many others such that they stayed home on E-day.

Failed strategy by a failed Leader

O’Toole moved to the left and alienated his party’s socially conservative base, along with fiscal and democratic conservatives, as a deliberate strategy which he claimed was necessary to finally defeat the Liberals.

He explained this leftward lurch, stating: “I told Conservatives that our party needed the courage to change because Canada has changed”.

In plain English, he meant, “To beat the Liberals, we have to become liberal like them”.

Throughout the campaign, O’Toole insulted the social conservatives whom he courted during the Conservative Party of Canada (CPC) Leadership race, and who crowned him Leader.

He shamelessly promoted abortion, LGBTQ ideology, oppressive lockdowns, and liberty-destroying vaccine passports which coerce Canadians who conscientiously object to taking the jabs for a variety of reasons.

He betrayed the party’s large socon base during the campaign trail when he flip-flopped on his previous pledge to protect conscience rights for healthcare workers to not have to perform nor refer patients for abortion or euthanasia. In doing so, he even contradicted official CPC policy as passed by grassroots members at a recent convention.

After just the slightest bit of pressure from the liberal media, he reversed his position and said that he’d require doctors to refer for abortion and euthanasia, not appearing to understand nor care, what a catastrophic violation of conscience that would represent.

O’Toole even angered fiscal conservatives by announcing his own job-killing carbon tax after repeatedly promising to repeal Justin Trudeau’s!

What was the result of O’Toole’s left-wing, Liberal-lite election strategy? Did it attract more votes to the CPC and bring about the victory he promised?

No. The exact opposite occurred.

Facing a Prime Minister Trudeau who was personally unpopular, and a public that was ready for change after 6 years of scandal and mismanagement, O’Toole performed worse than Andrew Scheer did in 2019, losing two seats in the House of Commons.

So much for leftism as a winning election strategy for Conservatives!

O’Toole’s Liberal-lite platform also resulted in a massive drop in the popular vote for the Conservative Party.

In 2019 under Andrew Scheer’s leadership, Conservatives won 6,239,227 of the popular vote. Although numbers are not yet finalized, as of this writing, the O’Toole Conservatives received only 5,529,272 of the popular vote. That means O’Toole presided over a collapse of almost 710,000 votes.

Numbers show that O’Toole caused the loss by driving Conservatives to vote PPC

Maxime Bernier’s party saw enormous growth in this election, tripling the votes obtained by the PPC in 2019, increasing it from 1.6% of the popular vote to 5.1%.

As of this writing, the PPC obtained 842,087 votes compared to 294,092 in 2019.

What does it tell us that the popular vote for O’Toole’s Conservatives collapsed by roughly 710,00 votes while the PPC grew by approximately 548,000?

To me, it says that the majority of the PPC growth came from former Conservative voters abandoning ship and moving to a party that they perceived as better reflecting their values.

The reason for that was clearly because Bernier had a more truly conservative platform. He ran on:

  • defending freedom, fighting medical tyranny & globalism
  • abolishing the carbon tax
  • repealing Trudeau’s gender identity legislation (Bill C-16)
  • repealing the Liberal “conversion therapy bill” that would jail parents up to 5 years
  • and last but not least, supporting moderate pro-life legislation such as a ban on sex-selective abortion and promising that no topic, including anti-abortion legislation, is off limits in the House of Commons.

If we assume that 70% - 80% of the PPC vote consisted of dejected Conservative voters with the rest being a mix of people who never voted before, plus some Liberals and Greens attracted to Bernier’s freedom platform, that would account for between 348,000 to 416,000 of the CPC’s 710,000 vote shrinkage.

What about the 294,000 to 362,000 missing people who cast a Conservative ballot in 2019? Where did they go?

I believe it’s reasonable to assume that these are largely people who stayed home on election day in 2021 because they were disgusted with O’Toole’s radical slide to the left, became despondent, and gave up on the political process. In short, O’Toole conducted voter suppression on his own base.

We can prove with certainty that at least 14 seats would have flipped to the Conservatives if O’Toole hadn’t driven this segment of the party’s base into the arms of Maxime Bernier. See the chart below listing the 14 ridings where a Conservative candidate narrowly lost and the PPC vote was strong.

For example, in Kitchener-Conestoga, Carlene Hawley, a pro-life CPC candidate, lost to the Liberal by a mere 194 votes. The PPC candidate, Kevin Dupuis (also a pro-lifer), got 3,641 votes. If we assume that just 70% of the PPC’s vote was former Conservative voters who felt betrayed by O’Toole, Hawley would have beat the Liberal by 2,355 votes.

If these ridings alone had flipped blue, the seating arrangement in the House of Commons would now look like this, with the Liberals reduced to a much weaker minority:

     LIB:   149
     CON:  133
     NDP:    29

Please don’t make the mistake of blaming these 14 Liberal seats on Maxime Bernier.

Erin O’Toole is who must bear the full brunt of responsibility. It was the actions of the Conservative leader that caused this vote split. Had O’Toole come out with a platform similar to Bernier’s, even if it was softer or more nuanced to draw less ire from the media, all of these seats would have turned blue in my estimation.

But wait, there’s more…

The table below shows that another 23 Liberal and NDP seats could have flipped to Conservatives if not for the combined factors of (a) defection to the PPC and, (b) voters sickened by O’Toole’s Liberal-lite policies not getting out of bed on election day.

Column D shows that after accounting for the Bernier effect by assuming a 70% switch back to the CPC if O’Toole had campaigned on a truly conservative platform, the local CPC candidate wouldn’t have lost by much. Column E provides the drop in voter turnout this election versus last, which in most cases, could easily bridge the gap to produce a Conservative win.

For example, in Thunder Bay-Rainy River, after adjusting for the PPC factor, the Conservative candidate, Adelina Pecchia, would’ve been behind the Liberal by just 143 votes. But we observe that 1,168 voters who turned out in 2019 stayed home this election. Of that 1,168, could there have been 144 people who previously voted Conservative, but didn’t this time as a result of O’Toole? I think that’s very likely.

If we assume all 23 of the above ridings flipped blue, then the parliamentary standings would be as follows, giving the Conservatives a strong minority government:

     CON:  156
     LIB:   130
     NDP:   33

O'Toole must resign

I’ve made the case that O’Toole helped Justin Trudeau win, and sabotaged his own sure victory by aping Liberal policy on abortion, LGBT identity politics, medical tyranny, societal segregation and more.

He doesn’t deserve to be leader because of his support for the child murder we call abortion. However, for all these other reasons I mentioned above, every Conservative Party member should want O’Toole gone.

Campaign Life Coalition was the first to call for his resignation on election night. That was followed by a senior member of the CPC’s National Council, Bert Chen, launching a petition to “recall” O’Toole as leader, which, at the time of this writing has surpassed 2,700 signatures so far.

If the Conservative Party faithful wish to avoid an even greater vote-split with the PPC in the next election, which is what I believe will happen if O’Toole remains leader, and to avoid having the Liberals come up the middle to win again, then they all need to get onboard with dumping O’Toole ASAP.

They need to acknowledge that the Conservative Party needs to select a new Leader who will motivate social, fiscal and democratic conservatives to come back to the fold.

White (Liberal) Supremacy: White Minneapolis Voters Want to Defund the Police, Not Black Voters

 

Poll shows ‘defunding’ Minneapolis police is driven by white voters

A poll carried out for the Star Tribune, MPR News, KARE 11, FRONTLINE and the PBS series sheds some fascinating light on the ongoing debate on policing in Minneapolis.

Some in favor of the proposed amendment have seized on the responses to the question: Do you support or oppose replacing the Minneapolis Police Department with a new Department of Public Safety, which may include police officers and will focus on public health, and giving the City Council more authority over public safety?

On net, support comes from voters of both genders, white voters, voters under 65, college graduates and non-college graduates, and Democrats. This is a pretty broad range giving the measure 49 percent of Minneapolis voters in support compared to 41 percent against.

But take a look at the voters who are, on net, opposed to this measure: black voters, voters over 65, Republicans, and Independents. For a measure which is being pushed as necessary to fight ‘systemic racism’, it is extraordinary that black voters oppose it by five points (black women oppose it by a whopping thirteen points) while white voters support it by eleven points. It is striking to note, too, that opposition to this measure unites black, Republican, and independent voters.

Note, too, the use of the word ‘may’ in this question: this new Department of Public Safety may not include police officers, focus on public health, and give the City Council more authority over public safety. This vague wording is why courts initially struck the question down.

If, as is quite possible on this vague wording, the new Department of Public Safety didn’t include police officers, or included many fewer of them, how many of those answering ‘Support’ would still do so? Perhaps not so many. When asked: Do you think Minneapolis should or should not reduce the size of its police force? 29 percent of voters say it should but a hefty 55 percent show that it shouldn’t.

Again, breaking down the numbers reveals some fascinating things. Reducing the size of Minneapolis’ police force — which may well happen under the current proposal — fails to find support, on net, among a single group of voters sampled. It fares best among voters aged 18-34, white voters, and Democrats (net opposition of -6, -18, and -20 points respectively): It fares worst among black voters and Republicans (net opposition of a staggering -61 and -66 points respectively). Once again, blacks and Republicans are aligned on this question with whites and Democrats furthest from them.

None of this ought to be surprising. The quantity of policing in Minneapolis has fallen drastically over the last 18 months: Violent crime is up 19 percent so far this year: Black Minneapolitans have been the victims to a strikingly disproportionate degree. While ‘defunding’ the police is an ideologically driven crusade for younger, white, Democratic voters, for Minneapolis’ black voters it is, quite literally, a matter of life and death.
