A new threat to California's "sanctuary state" law is coming from municipalities that are fighting the controversial legislation.



On Monday evening, the city council in Los Alamitos, a small city in Southern California, voted 4 to 1 to exempt itself from Senate Bill 54, also sometimes called the the "sanctuary state" law, which took effect in January. The state law, which is being challenged by the U.S. Department of Justice, bars local authorities from asking about the immigration status of people during routine interactions or participating in federal enforcement actions.

"This is important for us, for our city, for our community," Warren Kusumoto, the mayor pro tempore of Los Alamitos said Monday before the vote. He said the local measure was needed because of "a conflict between two governing documents — the Constitution of the United States and the state constitution itself."

Added Kusumoto, "We have a military base over here, we have contractors here who do business with the federal government. And I just feel that this body owes them some kind of certainty and guidance in enacting this ordinance. It really is for us to say we believe in the Constitution."

In addition to passing the ordinance, the mayor said the city plans to file an amicus brief in support of the Trump administration's "sanctuary law" case against California. 



California Assembly member Wendy Carrillo, a Democrat who represents parts of Los Angeles, said in a statement. “The Los Alamitos City Council and Councilman Kusumoto in particular, are egregiously misinterpreting the U.S. Constitution and are on the wrong side of history; Los Alamitos has an opportunity to protect its residents, but is instead siding with a racist and xenophobic Trump administration hell-bent on instilling fear in immigrants across the nation."

It was a packed house that flowed outside of the council chambers! Hours of public comments went forward both pro and con. Read a copy of the ordinance at the end of this email.
But, ultimately, by a 4 to 1 vote the Los Alamitos City Council Voted to reject the California Sanctuary Law and adhere to the U.S. Constitution.

BREAKING: Despite warning from the @ACLU_SoCal, the City of Los Alamitos passed 4-1 a proposed ordinance that violates their legal obligation to uphold the #CAValuesAct. They also added an amendment to file an amicus brief w/ Sessions' lawsuit against the state of CA.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY

OF LOS ALAMITOS, CALIFORNIA, ADDING CHAPTER
9.30 CONSTITUTION OF THE UNITED STATES
COMPLIANCE

WHEREAS the members of the City of Los Alamitos City Council have taken an
oath to support and defend the Constitution of the United States and the Constitution of
the State of California, and

WHEREAS
, the State of California enacted SB54, called the California Values
Act, and

WHEREAS
, the California Values Act is codified into Governmen
Code Title 1,
Division 7, Chapter 17.25 entitled "Cooperation with Immigration Authorities", and

WHEREAS
, the Council of the City of Los Alamitos, a Charter City, finds that it is
impossible to honor our oath to support and defend the Constitution of the United
States and to be in compliance with California Government Code Title 1, Division 7,
Chapter 17.25, and

WHEREAS
, employees of the City of Los Alamitos, residents, business owners,
guests, visitors, employees and employees of the United States Department of Defense
who proudly serve our Nation while stationed on the Joint Forces Training Base, are
entitled to the protections afforded by the Constitution of the United States, the Bill of
Rights, and the Amendments to the Constitution, and

WHEREAS
, employers, including the City of Los Alamitos, operating within the
jurisdiction of the City of Los Alamitos who accept Federal Contracts and must comply
with Federal Law, including lawful requests for access to premises, and

WHEREAS
, the entire
Joint Forces Training Base may be required to comply
with Federal Laws and is wholly located within the boundaries of the City of Los
Alamitos, and

WHEREAS,
the California Values Act may be in direct conflict with Federal Laws
and the Constitution of t
he United States;

NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF LOS
ALAMITOS, DOES HEREBY ORDAIN AS FOLLOWS:

SECTION 1. The City Council of the City of Los Alamitos, California finds that the
above recitals are true and correct and incorporates them by
reference herein.
SECTION 2. Chapter 9.30 Constitution of the United States
Compliance is hereby
added to the Los Alamitos Municipal Code as follows:

The
City of Los Alamitos, a Charter City, does
hereby
exempt the City of Los
Alamitos from the California Values Act, Government Code
Tit
le 1, Division 7,
Chapter 17.25 and instead will comply with the appropriate Federal Laws and the
Constitution of the United States.
SECTION 3. If any section, subsection, subdivision, sentence, clause, phrase, or
portion of this Ordinance for any reason is held to be invalid or unconstitutional by the
decision of any court of competent jurisdiction, such decision shall not affect the validity
of the remaining portions of
this Ordinance. The City Council hereby declares that it
would have adopted this Ordinance, and each section, subsection, subdivision,
sentence, clause, phrase, or portion thereof, irrespective of the fact that any one or
more sections, subsections,
subdi
visions, sentences, clauses, phrases, or portions
thereof be declared invalid or unconstitutional.
SECTION 4. The City Clerk shall certify as to the adoption of this Ordinance and shall
cause a summary thereof to be published within fifteen (15) days of
the adoption and
shall post a Certified copy of this Ordinance, including the vote for and against the
same, in the Office of the City Clerk, in accordance with Government Code Section
36933.

Complete Statement to Los Alamitos City Council: I Welcome the Announcement to Reject SB 54


My name is Arthur Schaper, a long-time resident of the city of Torrance.

I welcome the announcement and the courage of this city council, their decision to reject SB 54, the so-called sanctuary state law, which in fact is a piece of outlaw legislation, if anything else.

Your decision is not an act of nullification, but a restoration of the rule of law in our state and in the country.

The United States fought a civil war 150 years ago which affirmed that the United States Constitution is indeed the Supreme Law of the Land. Article VI Section 2 declares:

This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding.

While the Tenth Amendment is a much-abused and ignored Amendment in the Bill of Rights, it does apply to immigration, which belongs fully to the purview of the federal government.

This action is a much-needed remedy against the lawlessness of the Sacramento Political Class as well as the Brown Nazis who want to steal this land and make it Mexico. The United States won the Mexican-America war from 1846 to 1848. The country purchased the land for $40 million US, which today would be $1 billion. As much as these Brown bigots don’t want to hear the truth, Mexican nationals during the Mexican-America War wanted to become Americans and begged for the American President and Congress to annex the entire Mexican nation into the US.

Furthermore, the American Civil War was not a simple conflict between North and South, but even within the South, pro-Union and anti-Slavery forces seceded from the Confederacy and reasserted their commitment to life, liberty, and the pursuit of happiness. Western Virginia refused to secede, and they ended becoming a separate state. Eastern Tennessee nearly broke away, too, and free cities throughout the South emerged, declaring their break with the corrupt, lawless, pro-slavery Confederacy. It seems to me that if the Democrats in Sacramento had their way, they would re-instate slavery against blacks, too!

It is truly a shame that California’s elected officials have put illegal aliens ahead of American citizens. From Kate Steinle to Ruben Morfin, Dominic Durden, Brendan Mendoza, Marcello Bisarello and the average of 25 Americans a day killed by illegal aliens, it’s time for We the People to take back our state and make sure that those lives are not lost in vain.

This is your time. You have not just the opportunity, but an obligation to reject SB 54. I will be urging my city council and every city I can contact to do the same.

Sanctuary policies are complete falsehoods. They do not protect American citizens. They invite drugs, crime, rape, murder. The argument that sanctuary jurisdictions provide protection for illegals to report crimes is absolute nonsense. Crime rates are soaring across the state, and illegal aliens are a large part of this.

Once again, SB 54 is patently unconstitutional. The state of California and every municipality within the state is bound to comply with federal law on this and every other matter, and the city of Los Alamitos is taking the first step to sure that this happens.

Please approve this ordinance, cooperate fully with ICE and all other federal immigration laws and and law enforcement, and Let’s Make California Constitutional Again!

VICTORY! Los Alamitos, CA Rejects California Sanctuary State Law, Restores US Constitution

This is an incredible day.

This is a dream come true!



Finally, a municipality in the state of California took a stance against the rampant lawlessness of the SB 54 sanctuary state law.



Los Alamitos had to take on the lawlessness of the California state legislature, which insisted on pushing this lawlessness in voters' faces.

This is YUGE!
