Breaking: Ventura Candidate Sues to Restore Citizen Right to Run for County Office

Court battle to restore citizens right to run for the public office of elected County Sheriff.
The County of Ventura, at the expense of the taxpayers, has filed it’s reply to our brief, and we have filed our response. The case is now fully briefed.

The County, chose to not even attempt to rebut our argument that the CA Legislature has no authority to impose a ‘ballot requirement” over what is specified in our CA Constitution. The CA Constitution is quite clear in Article 1 Section 7(b) A citizen or class of citizens may not be granted privileges or immunities not granted on the same terms to all citizens.” The CA Constitution calls for the ‘election of county sheriffs’. There are no ‘qualifications’ as to who may run as all adult citizens have the right to run for all public offices.

The County failed to even attempt to rebut our citing of three different cases that confirm that it is the right of the citizens to run for public office.

The County refused to even attempt to rebut our citing of Baca v. Los Angeles that confirmed that not even a  ballot initiative can impose a requirement on the elected office of County Sheriff.  

 The County refused to attempt to rebut our citing of the Colorado case that an elected Sheriff may not be ‘required” to be ‘certified” in way other than to be elected to be the County Sheriff and receive the compensation for that office.



 The County tries to argue that a case filed by a presumptive write-in candidate, who acted as his own attorney, who argued a vague right to have his votes be counted as a ’free speech issue”. The County’s only argument , that they make over and over… is that the County Clerk, Mark Lunn, has a legal responsibility to carry out the law. We do not disagree, we only argue that the ‘law” is unconstitutional.  We now wait on a trial date: Without wanting to seem overconfident, we are however extremely confident that we will prevail. No doubt the County will appeal to the State Supreme Court. We will prevail, the County just wishes to continue to deny the citizens their right to run fro ALL public offices and vote for the candidates of THEIR choice. The County BofS seems most willing to spend ALL of our tax dollars to pursue this.

 We expect that this ruling , s the law was Statewide, will result in the Court finding that ALL County Sheriff elections results as invalid. Expect 58 statewide County Sheriff elections with public citizens on the ballot!

Kavanaugh Almighty!, by Carol Houghton


We don’t know about you, but we are definitely excited for the upcoming days when Supreme Court Justice Brett Kavanaugh singlehandedly overturns Roe v. Wade, causes more global warming to happen and places a fully-automatic machine gun in the hands of every middle schooler.



Quick question: If one Supreme Court Justice has as much magical power as the left ascribes to Brett Kavanaugh, why hasn’t Ruth Bader Ginsburg incinerated all of us Deplorables already?

The Senate confirmation hearings for Judge Kavanaugh were a sight to behold this week. Deranged lunatics were screeching, howling and bursting into tears in the Senate Judiciary Committee at the inevitability of Kavanaugh’s confirmation. Those insane people shrieked almost continually and at times, it felt like the hearings were going to have to be canceled just for safety’s sake.

Oh, and some civilian protesters showed up, too.
The mainstream media was sure to let us know that there were women on the balcony overlooking the chambers who were dressed in Handmaid’s Tale costumes. Look at all of those ordinary, concerned female citizens turning out to stand up for Roe v. Wade! Why, they’re a veritable plethora of everyday Americans, declared the MSM.

Except… later on in the day, conservative outlets identified them as members of the DC-area Antifa fugly squad. Trust us, those brand-new scarlet and white costumes are the cleanest clothes those “ladies” have had on since November 8, 2016.
Plus, we didn’t know that handmaids are allowed to use cell phones. Paging the Patriarchy Police!

Within the Senate chambers, it was an absolute zoo. The Democrats were howling and screeching like a pack of… oops, we almost said, “monkeys,” but thanks to the media’s coverage of the Florida primaries, we know that monkey is now the new N-word. Let’s just say the Democrat protesters were out of control.

Don’t think, however, that it wasn’t planned that way. Sen. Chuck Schumer (D-NY) gave the Democrat Senators and the civilian protesters their marching orders in a conference call last week. The whole charade was carefully orchestrated, right down to a George Soros-funded leftwing organization paying the protesters from a bag of cash, right outside the Senate building.

Three doctors who were waiting in line, in hopes of getting inside to watch some of the proceedings, saw a dude with a bag of cash handing out money to people. They thought that was weird, so they snapped a photo of the money-man. Sure enough, the woman he was handing cash to was later ejected from the hearing for howling like a… can we say “banshee?” Is the word “banshee” still okay? Can we get a ruling on that?


Twitter sleuths quickly identified the money man as Vinay Krishnan, a consultant for the Center for Popular Democracy. The Center for Popular Democracy is, in turn, one of the anti-Trump groups that billionaire socialist George Soros dumped massive amounts of cash into earlier this year to resist Trump.

The Center for Popular Democracy is almost completely funded by Soros. Thus, the protests that you saw on TV at the Kavanaugh hearings were brought you by George Soros. Thanks, George.

Here’s a fun fact that Mitch McConnell could take advantage of to ensure that such a circus never happens in the US Senate again. You can’t get into a Senate hearing unless you have a pass. You don’t get a pass unless a Senator’s office gives you one.

In other words, every single one of those insane, screaming, howling lunatics (you thought we were going to say banshees again, didn’t you?) was given a pass by a Democrat Senator.

Mitch McConnell could simply change the Senate rules to fix this once and for all. If you have a guest in the Senate chambers that has to be ejected for too much crazy, your office gets no more passes. Period. Problem solved.

And you know it just wouldn’t be an anti-Trump media spectacle without a loony tunes conspiracy theory about white supremacy. Boy, did the Democrats deliver on that promise! One of Judge Kavanaugh’s advisors was seated directly behind him, and she was… OMG, she was flashing a white supremacy hand signal to the cameras for like, totally an hour!

Of course, that conspiracy theory fell apart when it was revealed that the perceived KKK lady was Zina Bash, a Jewish-Mexican staffer of Kavanaugh’s.

Our favorite part of the hearing, however, had to be when Sen. Cory Booker (D-NJ) had his moment in the shining sun, pulling a campaign stunt to indicate that he’s running against Trump in 2020. “This is my Spartacus moment!” Booker thundered to the cameras.



Oh, boy. Anytime a Democrat tells you how courageous they’re being, get ready to be informed of something banal that doesn’t even vaguely resemble courage to a normal person.

Remember, the Democrats thought that FBI stooge Peter Strzok deserved a Purple Heart for testifying before the House Judiciary Committee – which is part of the regular duties of senior FBI officials. “He’s doing his job! It’s just like being shot by the Taliban!”

Courage to a Democrat usually means making it halfway through a meeting before sending out a fundraising email about how brave they’re being.

Okay, Spartacus Booker! Dazzle us with your courage! We’re ready to swoon!

Booker declared that he was breaking the Senate rules to release classified Kavanaugh documents that Trump doesn’t want the public to see. And even though SPARTACUS BOOKER could lose his US Senate seat for misconduct by BREAKING THE RULES IN REBELLIOUS FASHION, JUST LIKE HEROES FROM DAYS OF YORE (!), he was willing to make that sacrifice for America. That’s how brave SPARTACUS BOOKER is!

Except the documents had already been declassified before the hearing started. It was a nice speech, though, Spartacus. ‘A’ for effort.




And as for the “classified” info that Trump didn’t want the public to know about, it was an email exchange between Kavanaugh and someone else in the Bush White House. Kavanaugh said in the emails that he didn’t want to rely on racial profiling of Arabs in the days after 9/11. Hey, no wonder Trump didn’t want the public to see it!

So, in the end, Spartacus Booker’s big rebellion revealed to the world that Brett Kavanaugh is opposed to racial profiling. You’d think the Democrats would have wanted to hide that.

This was a watershed moment though, because up until we saw the documents, we were unable to learn any of Kavanaugh’s positions on any legal issues. That’s because Kamala Harris and Dianne Feinstein had been interrupting him for two straight days.

As for Kavanaugh’s real worth as a US Supreme Court Justice, if he’s even 10 percent as conservative as the Democrats and the media assure us he is, it’ll be an improvement over Anthony Kennedy.

US Senator Mike Lee: The Best Pick to Replace Anthony Kennedy on SCOTUS

Supreme Court Associate Justice Anthony Kennedy, the swing vote who would sway the court rulings pretty much any way he wanted, has announced his retirement. His departure has sparked incredible (wonderful!) panic from the left, and great elation from the right. But his retirement was long expected. Rumors swirled online and in print last year that he would step down after Justice Neil Gorsuch’s confirmation. Some reports even suggested that Gorsuch helped cement Kennedy’s decision to retire sooner rather than later because of their strong friendship, which began when Gorsuch clerked for Kennedy in the 1990s.

Despite his liberal rulings on abortion and marriage (his most charitable supporters consider him libertarian), Kennedy was a longtime ally with the conservative wing of the United States Supreme Court, especially during his last term on the court. He has accomplished so much good under the Trump Administration. He sided with public sector workers to stop the legal theft of their wages when they choose not to join a union. He supported the president’s constitutional travel ban against rogue nations. He also stood with freedom of speech, striking down an abortive law which would have required pregnancy centers to inform their clients of abortion options.



Last November, President Trump updated his list of 25 nominees, which had included Neil Gorsuch, and he will draw from that list. Unlike previous presidents, Trump has responded to input from the public as well as from his advisors. Circuit Court Judge William Pryor looked like a possibility, but the uproar about his squishy stances on individual liberty and pro-family issues have pushed him away. Shortly after his inauguration, the president whittled down his nomination to two candidates to replace Scalia: Thomas Hardiman and Gorsuch. Trump could move forward with Hardiman next. A federal circuit court judge in the crucial swing state of Pennsylvania, Hardiman carries a working-class temperament that could force Red State Democrats to vote for him.

However, based on the current, more politically fraught landscape in the U.S. Senate and across the country, there is a better pick on the president’s list: U.S. Senator Mike Lee. A sitting U.S. senator? His nomination would not be unheard of. Retired and sitting elected officials from the House of Representatives and United States Senate have served on the Supreme Court before. In fact, even a former president, William Howard Taft, served on the court—and as chief justice, no less.



What makes Lee the preferred nominee to replace Kennedy?
  1. He’s a staunch constitutionalist. He has written books and given many speeches on this subject.
  2. He has the highest rating from the American Conservative Union of all his colleagues, even higher than Cruz. He has maintained this rating even following his re-election in 2016. Normally, legislators get more “swampy” when they return to Washington. Not Lee, though.
  3. He would be easy to confirm. Unlike his conservative colleague Ted Cruz, Mike Lee has sought to foster peaceful relationships with every member of the United States Senate, but he still voted along his conservative principles. Senate rules permit Lee to vote for himself. Even without McCain, 50 votes plus Vice President Mike Pence would get him confirmed. At least two Red State Democrats would support Lee, too.
  4. He’s not a knee-jerk Trump supporter. Independence is crucial to begin with for our Supreme Court nominees. Politically, this decision is going to raise more ire from the left and within the Democratic caucus. Socialists are cannibalizing the establishment, and their representatives need to do everything they can to appease them. They can’t vote for a “Trump” cheerleader. Even within the GOP caucus, there are Republicans who are wary of Trump and want to stand apart, including the two moderate Republicans Susan Collins and Lisa Murkowski. They can vote for Lee and not worry about offending their moderate-liberal sensibilities. 
  5. He wants to restore federalism and separation of powers. Enough said. His push to restore tariff setting powers to Congress is one proof of this, regardless of the powers behind the scene lobbying for this legislation.
  6. He’s had an avid interest in the Supreme Court since he was a kid, and his father served as Solicitor General of the United States.
  7. He’s young. At 47 years, he is one of the youngest prospective nominees on the list. In North Dakota, Trump said he wanted someone who would stay on the court for 40 to 45 years. Someone like Lee would meet that need.
On a broader note, the Utah senator could provide the constitutional correction needed to curb the federal judiciary. Following from the power of judicial review established by Marbury vs. Madison, the Supreme Court has arrogated too much power to itself.  Any legislation which falls within the 9th and 10th Amendment, which outlines powers unwritten in the Constitution and belonging to the states and the people, have been routinely struck down. Based on his temperament, voting record, and rhetoric, Supreme Court Justice Lee could restore checks and balances among the states as well as among branches in the federal government.

Pundits left and right view Lee as the likely choice, too. Vox Magazine lists him as a conservative favorite, as does U.S. Senator Ted Cruzradio host Mark Levin, and the Governor of Utah. Bloomberg News reports that he is in active consideration. 

Last of all, Lee’s appointment would not risk the GOP Senate Caucus majority. Despite the precarious partisan divide, Lee’s seat would not fall into Democratic hands. He won re-election in 2016 by an overwhelming margin. The Governor of Utah could appoint the solid, well-known Dr. Michael Kennedy to replace Lee without any trouble.. There’s no chance of a Roy Moore redux occurring in Utah.



A century ago, another Republican U.S. Senator from Utah, George Sutherland, won confirmation to the highest court. A clear-cut conservative who relentlessly opposed the New Deal and a telling precursor, Sutherland sounds a lot like Mike. President Trump should select Mike Lee for the Supreme Court.
