HOLY CRAP! Caltrans Breaks the Law to Fight Yes on Prop 6 Campaign

Now this is just sickening on a whole new level.

The California state government agencies have colluded for decades to keep themselves rich with our tax dollars.

When does this insanity stop? They have gone so far as to instruct Caltrans workers to pass out literature on taxpayers' time to oppose Prop 6.

This is wrong, and we cannot allow this!

In Blatant Violation of State Law, Caltrans Work Crew Caught Stopping Traffic to Distribute Campaign Fliers Opposed to Prop 6 Gas Tax Repeal Initiative

Yes on Prop 6 Campaign Files Ethics Complaint with Three Law Enforcement Agencies
California state law expressly prohibits the use of taxpayer money to engage in a political campaign, but that’s exactly what happened on a busy California highway this week when a Caltrans work crew being paid taxpayer funds to work on a road project decided to use the project traffic calming process to stop traffic and hand out “No on Prop 6” campaign fliers. Traffic was delayed 18-24 minutes and motorists were furious with the clear violation of state law in using taxpayer monies to campaign.
Photos, video, and witness testimony of the incident was released at a press conference along with a Criminal Complaint alleging violation of numerous state and local laws. The campaign flier passed out clearly contains prohibited “express advocacy” language such as “Vote NO on Prop 6” and the Caltrans work crew member is caught on video admitting he was “working with Caltrans” and “They just told me to hand it out.”  
“There is absolutely no grey area here, Caltrans is caught in blatant violation of California law that prohibits the use of taxpayer funds for campaign activities or advocacy,” declared Carl DeMaio, Chairman of Yes on Prop 6 Gas Tax Repeal Initiative. “This proves once again that Caltrans simply cannot be trusted to do what is right with our gas tax funds – they literally are using gas tax funds to support the distribution of campaign materials to raise the gas tax on working families,” DeMaio noted.

The incident occurred along State Route 78 in San Diego County between Julian and Ramona on Tuesday, August 28, 2018 between 7am and 3pm. Caltrans contract and task order records confirm that a road project was scheduled for that very stretch of highway. A Caltrans contractor assigned to the project was photographed at this site along with a Caltrans vehicle and supervisor. California state law prohibits the use of private contractors paid for by taxpayer funds for any political purpose.
“We demand an immediate investigation into this incident, we demand prosecution of the individuals involved, and we insist that the Governor instruct Caltrans to immediately cease any activities that could be interpreted as campaign activities,” DeMaio concluded. 
The Criminal Complaint was submitted to the San Diego County District Attorney, California Highway Patrol, and the California Fair Political Practices Commission (FPPC). The alleged criminal violations are detailed below.
CRIMINAL VIOLATION - 1
California Government Code Section 8314 declares “It is unlawful for any elected state or local officer, including any state or local appointee, employee, or consultant, to use or permit others to use public resources for a campaign activity, or personal or other purposes which are not authorized by law.”
By utilizing and directing a taxpayer-funded vendor/consultant to distribute “express advocacy” campaign fliers while being compensated under a task order at a project site, Caltrans and Manhole Adjusting Inc., as well as employees involved in this incident, have all violated state law.  
CRIMINAL VIOLATION - 2
California Vehicle Code Division 11, Section 22000 declares No person shall bring a vehicle to a complete stop upon a highway so as to impede or block the normal and reasonable movement of traffic unless the stop is necessary for safe operation or in compliance with law.”
Respondent may argue that traffic needed to be slowed for the purpose of the work being performed, however, several witnesses reported that no work was being performed during the times that they were slowed and stopped for the distribution of the “express advocacy” campaign fliers.  
Additionally, even during times when road work was being performed by some of the Caltrans work crew, the appropriate action would be to merely slow traffic.  The extraordinary and excessive act of completely stopping traffic and impeding drivers from navigating without first taking the “express advocacy” campaign flier for No on Prop 6. 
Through these actions that had a significant impact on delaying and impeding the flow of traffic, Caltrans and Manhole Adjusting Inc, as well as each employee involved in this incident, have violated state law.  
CRIMINAL VIOLATION - 3
The Regulations of the Fair Political Practices Commission, Title 2, Division 6, California Code of Regulations Section 18420 declares: “Reporting Campaign Contributions and Expenditures by State or Local Government Agencies. (a) Any candidate or committee that receives contributions from a state or local government agency must report receipt of those contributions… Nothing in this regulation should be read as condoning or authorizing campaign-related activities by a state or local government agency. Under many circumstances, such activities may be illegal. See Penal Code section 424; Government Code section 54964.”
The Regulations of the Fair Political Practices Commission, Title Title 2, Division 6, California Code of Regulations Section 18421.1 declares: “Disclosure of the Making and Receipt of Contributions. (f) A nonmonetary contribution is "made" by the contributor, and "received" by the candidate or committee, on the earlier of the following dates: (1) The date that funds are expended by the contributor for goods or services, if the specific expenditure is made at the behest of the candidate or committee;
While the contribution by a state or local government agency is strictly prohibited under California law and any individual or government agency can be punished for such action, it is also against the law for the No on Prop 6 committee to receive and to fail to report any in-kind contribution from a third party in support of its campaign. 
In this case, No on Prop 6 actively provided campaign materials to government agents knowing that public funds would be utilized in covering the salaries of employees distributing the campaign fliers.  Through these actions, and failure to disclose the nature of the in-kind value of the contribution, the No on Prop 6 campaign has violated the California Political Reform Act and associated regulations.

Facts about this massive hike:
–Voting Yes on Prop 6 will repeal the car and gas tax, and ensures that any future car and gas taxes must be approved by the voters
–On Nov 1, 2017, Californians became subject to an additional tax of 12.5 cents more per gallon (20 cents more for diesel)
–Estimates suggest it will cost an average family of four $700 or more per family, per year
–The tax also hits business owners who rely on transporting goods, raising the cost of everything from apples to bread, and everything in between
–Vehicle license fees (car tax) will increase as much as $175 a year - striking the wallets of hard-working families across the state
–The tax revenue goes into the state's General Fund, meaning there's zero guarantee the money will be used to actually fund the transportation "fixes" they claim will happen
–Nearly 1 million signatures were collected to qualify the measure on the November ballot; just over 550,000 were required

Shameful! RPLAC Refused to Take Gas Tax Repeal Literature (Major CYA Followed)

The Republican Party of Los Angeles County Central Committee is a RINO-infested mess.



The leadership revoked the charter for two volunteer clubs:

1. The Beach Cities Republicans
2. The Mountain View Republican Club

The reasons?

Our clubs were actively conservative, pro-Trump.

I had invited Latinos for Trump founder Marco Gutierrez to speak to our club, and the leadership of the local central committee told me to cancel the meeting. She even called my work to try and convince my boss to get me to cancel the meeting.

Corrupt and illegal.

The central committee recently exposed how not just out of touch, but unwilling and uninterested they were in helping the conservative cause in the state of California.

The John and Ken Show interviewed Carl DeMaio, and he exposed that the RPLAC Central Committee blew off De Maio and the Yes on Prop 6 campaign.

I am not surprised that they would blow off any interest in doing something worthwhile for any Republicans in Los Angeles County or even throughout the state of California.

Thank you so much for that video. Somebody at the TLRA B-B-Q told me yesterday about the county party no supporting the Gas Tax Repeal. I have to say I was stunned but not really surprised. This is the proof that we needed to hear that the L.A. County GOP is not in our corner but stands with Gov. Moonbeam. Yesterday I wrote you that the LA County GOP needs to lead, follow or get out of the way. Forget that. It is now clear they need to just get out of the way because the GOP base will not stand for this type of betrayal. You can't spin this. Richard Sherman and his LA County GOP team have sold us out and they need to resign ASAP. All they will do is lead us down the road to another wipe out defeat like in 2016.

Here is what happened with the YES on 6 Signs:
First of all, let me say that of course the LAGOP supports the repeal of the gas tax, and supports the YES ON 6 group, and has from the beginning.
The LAGOP offices are on the fifth floor of a high-rise security building. We have two small rooms which are overcrowded as is. It is a security building, which means you have to check in with the security guard in the lobby before coming up, and if you park in the building the parking rates are outrageous.
Because of all these conditions, the offices of the LAGOP are not suited for distribution of signs. Volunteers will wind up paying $5-$10 for parking and will have difficulty getting up to the offices. Additionally, we just don’t have the room for signs.
Last week a driver showed up with 1,000 signs, without prior notice and left them in the hallway because they were too many to get into the office. Our Executive Director called the County Party Chairman who explained to the driver that the offices of the LAGOP are not suitable for distributing 1,000 signs, and that we have 14 other locations in LA County where signs are being distributed for YES ON 6.
The driver went back and without reporting the details or reasons, stated that LAGOP had refused to distribute signs, which was totally inaccurate. Whoever reported to Carl DeMaio just reported that the LAGOP had refused to distribute signs. That is why Carl said what he said on the John and Ken show on Friday.
Carl has now been informed as to what the real story is and sent out the following tweet this morning. He is going on the John and Ken show on Friday to explain what happened.

There is nothing which suggests that it is a matter of course for the Republican Party of Los Angeles County to support the repeal of the gas tax. There is nothing to justify or to censure this sentiment.

If the building is as secure as they claim, then how did Carl end up providing the signs in the first place? "There wasn't enough room for the signs." Sure, whatever you say, buddy.

This is a load of garbage, no matter how one looks at it. By the way ... how come the County GOP office is in such a high rise to begin with? Is it that they are hiding something? Are they trying to avoid any kind of connection or with the public?

How is it possible that there would be so much miscommunication? There is a lot more to this mess than has been reported, as usual. I have emails from SCAM-inoff, in which he reports that the RPLAC revoked the charter of the Beach Cities Republicans for other reasons, not the ones stated to the public. 



The RPLAC leadership have a habit of lying, of hiding the truth, of dishonoring the base in the county. There is no reason why anyone should believe anything that they say.

Final Reflection

I never thought I would see the day that the corrupt RINO central committee would get shredded in such a public fashion. I will be honest: it was quite gratifying and liberating to see these corrupt liars getting raked over their feckless laziness.

Yes on Prop 6, Repeal the Gas Tax Meeting, Torrance (Photos and Video)

Former San Diego City Councilman and Congressional candidate came up to Torrance, CA to help rally the troops for the repeal of the hateful, dreaded gas tax, the car tax, and the passage of a constitutional amendment to ensure that the state could never raise the gas tax again without vote consent first.

The room was filled up with no chairs to spare, and yet people continued to attend.

Keep in mind that this meeting took place on Monday afternoon. It is very difficult to get people to do anything political on a Monday mid-morning or afternoon.

But there we were.





























There is a lot of momentum to repeal the gas tax.

The Reform California movement got rid of State Senator Josh Newman.

Now we need to repeal this dreaded gas tax.

Then we will start knocking out all the other state senators who plowed the average California worker with higher taxes and fees.

Election 2018: Gas Tax Repeal Initiative a GO!


The movement to take back California is picking up steam like never before.

First, the recall of Josh Newman was a rousing success.

Now, the official initiative to repeal the odious gas tax is on the ballot for November.

I don't care how many public projects are taking place (or rather, space) all over the state's highways and byways. There has always been enough money to fix our roads, but Sacramento politicians wanted more for their pet projects, special interests, and of course the illegal aliens.



Thank God that more people are activating their power as citizens to stop this insanity.

Can't wait to repeal the hikes on our gas and the car registration fees.

WE DID IT!! Late yesterday we received the official notice that the Gas Tax Repeal Initiative has officially qualified for the November ballot!

As you know, we were concerned over the slow pace on signature verification by government officials. After threatening action over the delay, the signature verification was completed. Imagine that!

So what happens next, you ask.

It’s simple: We mount the most aggressive grassroots campaign California has seen since the passage of Prop 13!! 

As you can see by our success so far with the Recall of Josh Newman and the Repeal Initiative signature drive, we are following a disciplined, methodological strategy for what we do. However, we need the funds to carry our strategy out and win.


Remember, Gov Jerry Brown has millions to throw against us in false and misleading ads. We need to be ready to get the truth out about how much the gas tax costs working families and how the politicians can divert the funds away from roads!

Final Reflection

The fight is far from over, of course. Getting rid of Josh Newman took a lot of work from thousands of people all over the state. Now, we need to get rid of this awful gas tax, and then we can target other "undocumented" politicians who raised our taxes to fund Sacramento's insatiable demand for our money.

Great news! The Los Angeles Times just reported a new statewide poll showing an overwhelming majority of California voters think the gas tax should be repealed!

There's just one catch: we have to collect the 500k signatures to force this issue on the ballot.  We kick off signature collection Nov 27 – just TWO WEEKS from today!

We are two-thirds the way to getting our funds we need to launch the petition drive.  Can you contribute anything today?  We really want to raise the funds *this week* because we know next week will be tough with Thanksgiving and all.
